Gladstones letter before claim

Hi,

I previously hijacked someones thread by accident but have started a new one! Apologies!

When the driver visits there sister (which is quite often) the driver normally park in a visitors bay with a visitors permit but if there are no spaces anywhere the driver parks in an undesignated place.
In the past the driver has got parking charges which the driver have ignored and nothing has ever come of it but recently the driver got 2 which the driver never responded to of course but now received a letter before claim.

    You have to deal with the LBC; no more ignoring.

    The NEWBIES FAQ sticky, post #2 tells you everything about handling the LBC, right through to any court hearing. The sticky must now be your Bible in terms of working through all this. Refer to it frequently, and whenever there is a new stage to your case.

    Hi,

    The driver had responded to a letter before claim by a template four by "coupon mad" which was great!
    This morning the driver has received an 8 page letter from Gladstones saying "Thank you for your correspondence. We confirm our Letter Before Claim is complaint with the most up to date version of the practice direction for pre-action protocol."

    It says I have a further 30 days from this letter to pay or failure to do so will result I further legal proceedings being issued against the driver.

    There is no signature just says Gladstones Solicitors at the bottom in bold.

    The first few pages are FAQ then another page of debt advice places I can call.

    The next pages are a reply form to tick boxes.... I agrees I owe the debt..... I owe some of the debt but not all of it......i don't know weather I owe the debt.....i dispute the debt.

    the next section is how will you pay and the final pages are to fill in a financial stem enter if you have requested to pay in instalments.

    I would like to know what the drivers next step would be and if anyone else has had this next step of letter as when reading the threads I have read people getting a LBC then court proceedings.

    Are you saying that you park in a bay belonging to another resident? If so, you appear to haver a very cavalier attitude towards other peoples' property. It is because of such behaviour that MAs appoint these scammers.
    You never know how far you can go until you go too far.

    Who is the parking company ?
    Are there clear signs displayed that can be seen
    both day and night ?

    It could be a commission agent not employed by the PPC
    which could be neighbour

    Reply and deny the debt requesting proof of the
    landowners authority to the PPC.
    DO THIS NOW

    In the meantime, get your sister to contact the
    landowner or management company to get this
    cancelled as it is restricting her family to visit her
    She needs to do this quickly

    Perfectly OK and normal for any solicitor firm.

    Hi,
    The drivers sister has a few nice neighbours which go away some weekends so we have permission from them, so no I would to park in someone else!!!8217;s bay without consent.
    The parking charges are not for that.

    The parking company is called parking and property management limited.

    Does the driver tick the box to say I dispute the debt if I do this I have to explain why on a separate piece of paper.

    Thankful for your reply as a little stressed :/

    Don't get stressed, you are just dealing with scammers
    and their dodgy legals

    You do not have to explain anything, it is for them
    to provide the proof
    You simply reject the claim and request proof and
    a valid document giving the PPC the rights to issue
    tickets. The latter they will probably refuse claiming
    data protection but if they proceed, a judge would
    need to see on what authority

    The neighbour who gives permission whilst away
    is very important, get a statement from them giving
    your sister authorisation
    No parking company has the right to over ride a
    resident, doubt if the MA would do that
    However, the parking cowboys do what they want

    The WS I received from PPM/Gladstones for my case was signed by a 'David Blake', presumably the same 'Mr. Blake' referenced in that prankster post.

    A bit of googling reveals a 'David Blake' living in the same general area as PPM have their offices who seems to have a very shady history in the 'parking enforcement' industry, one of his previous clamping companies were ASBOd by the council.

    Coincidence? Maybe this is why he wants his name off the Companies House roster?
