    I phoned them up yesterday and gave my card details and set up a monthly plan to pay £20 a month, they said they will phone me again to confirm everything and get it started.
    Nonononono. STOP THAT, as has been said. Revoke your permission and ask them to allow you POPLA as an ADR as you wish to appeal.

    They'll say 'no, it's too late' and you can say 'see you in court then'.

    This is still defendable and costs no more even if you lost (and we win 99% of the time). No solicitor or company needs to be paid any wasted money.

    Tell your friends NOT to phone these ex-clampers and not to ignore them if they get a PCN - this would have been easy to beat at POPLA with the right appeal from the keeper (never saying who was driving).
    PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

    Their ONLY method of enforcing any form of payment is court action.
  • Well what i dont understand is under what ground id argue in court, like what i be asaying? I didnt buy a ticket so arent they so far in the right? Even tho theres no physicial machines and its not been advertised that parking charges are being reinforced?

    You're in your second year of a LLB degree course and you don't even know the basics of contract law?

    Is this the University of Muppets, or are you just sleeping through all the tutorials?

    I have been providing assistance, including Lay Representation at Court hearings (current score: won 57, lost 14), to defendants in parking cases for over 5 years. I have an LLB (Hons) degree, and have a Graduate Diploma in Civil Litigation from CILEx.     Althought one last question, after googling bmpa insight ice noticed minister baywatch do not take many cases to court, so i was wondering what would occur if they didnt take me to court? Nothing?

    Powerless debt collector letters regularly for about 6 months. Read the NEWBIES FAQ sticky, post #4 to learn how harmless, albeit irritating, debt collectors are.

    After 6 months all goes quiet. But you will know from your law studies that an alleged debt can be pursued through the courts for 6 years - so you’ll never really be sure that this has completely disappeared until 2023.

    But now isn’t the time to be panicked into paying as there is a Private Members Bill being introduced through the Commons in February which hopefully might see the private parking industry having some control placed on them. So that’s one very good reason to wait and see.

    You should also familiarise yourself with the very recent new Pre-action Protocol just introduced from 1st October which makes the issuing of small claims a much more arduous task than previously. It may be (but no guarantees) that being only an occasional litigant, MB might find it all too much faff to chase further parking charges through the courts. But, who knows for sure, only time will tell.

  • Umkomaas when i phoned to set up the finance i asked what would be further steps if i refuse to pay, the person on the phone said itd be taken to the solicitors do you think this implies theyre thinking of going to court?
