Problem with breakdown company

Hi guys,
I need some advice i got my car broke down two days ago and by mistake i contacted my previous breakdown company instead of current one.
The guy over the phone asked for policy number which i told him that i dont have with me right now, then the guy got my car reg details and my details and arranged recovery without telling me any cost or about my policy.
Today i received an invoice from them asking me £98 to pay as my policy was expired in July.
I got my call recorded and it clearly tells that it was their fault not to inform me that my policy has expired and there will be a cost for the call out.
I rang their debt department and lady told me that she is going to listen that call and will get back to me.
Any advice what shall i do next if they still refuse to accept their fault.

OP if they don't wipe off the charge, point out 2 things.
1) Your conversation with them lacks the elements required to be considered an offer/part of a legally binding contract
2) Even if it did amount to an offer, they failed to abide by their obligations under the consumer contract (information, cancellation & additional charges) regulations 2013.You keep using that word. I do not think it means what you think it means - Inigo Montoya, The Princess Bride0 -

What's not to be considered legally binding exactly?
Op phoned a recovery company with a view of obtaining recovery services. They obliged. Op now pays for the service.
In the absence of an agreed price all a court would look at is what is reasonable and the price they've charged doesn't sound unreasonable.0 -
Offer half by way of full and final settlement if you wish... But I doubt any court would dismiss the claim. You phoned them to use their services. Not the other way round. If you phoned the wrong company and could have got recovery free elsewhere then that's your problem not theirs.0

It's unfortunate that you broke down and had to call a recovery company,
It cannot be the fault of the company if you rung them, perhaps they have a service charter not to turn customers away in need (if they had point blank refused to come out wouldn't you have still complained?)
Perhaps the recovery agent who came out has a family to feed, it's only fair that you pay for products and services recieved.0 -
I cant believe how people blaming me, it was a honest mistake i have breakdown cover unfortunately i rang the wrong company which was actually my previous company.
How come a company send a recovery without letting new customer that there is charge and usually you have to pay upfront by card or cash. In my case they did not tell me anything and also they sent invoice to my address which was registered with the company anyway.
Basically my membership was live on their system (their fault) as i cancelled few months ago but they cancelled very next after the call out0 -

It maybe your opinion but i dont agree with it, how can they authorize a call out without any details of policy or any charges at all? hows that fair? they could charge £1 or £1000 anyways i got the call recorded so everything is there so lets see what they say..0
