Not admitting liability

Hello I am new to this forum and was wondering if anyone could offer some sound advice please.
On the 5th May I parked up at work and looked out of my rear view mirror and saw a car coming towards mine. I was parked at the bottom of a slope and this car was parked in the middle. The car hit the back of my car, I got out of mine to find no one in the other vehicle. A colleague had seen all if this happen, she called our reception. Someone from HR came out and sent me in to the office until the owner of car had been notified. The owner then came to my desk and stated that there was no damage as she had already checked and that her handbrake was on. I said look that's fine accidents happen let's have look. There was a bit of scratching and a bit of paint missing on first inspection. I said look it seems ok I'll speak to my husband how he wants to get it sorted out. I called him and he said to ask for her details, so I emailed her. She came to my desk and she was quite hostile and stated why do you want my details your car had already had a bump. I said erm no no It hasn't actually. It hasn't, never has. So I was quite taken aback with the way she was being. I asked her just to send me her details. She said she didn't have them but will email them on Monday. When I left the office that evening it was apparent her car had hit 1 or 2 of my parking sensors and they were not working. So the next morning I sent her a text explaining, again she stated her car did not cause the issue.
We have paid our excess of £350 and my car now has a new bumper. However I was informed today from my insurance that the other party are not accepting liability. So where does thst leave me and my £350? We don't have legal cover on the policy, we are fully comp.
She can't just get away with it surely!?

    Where was the car parked? In a place accessible to the public or a private works car park?
  • It's a private car park, she works in the same office. Yes they have witness details and lots of photos from different angles showing impact and damage.
    I don't think she can deny that her car hit mine, I think she is trying to claim that it didn't cause the damage. Surely that can't be denied?

    Your insurer should be pursuing this for you (ie the liability issue, not your excess which isn't covered by your insurance - it's your responsibility to pursue this from the third party insurer along with all your other uninsured losses/costs incurred)
  • I am sorry I don't know the difference, she hit my car and caused damage so she is liable... therefore is liable for costs incurred to me, which is the excess of £350 that's what I am trying to claim back. So she has to accept liability so I can claim my money back, if she doesn't accept I don't get my excess back? I am meant to chase this? Thought that's what I paid my insurance for?

    Yes, if liability isn't accepted you're £350 down and have an at fault claim to declare for the next five years.

    You may not have much choice.

    Yes, if she won't accept liability and her insurers won't pay up.

  • Well thats what I will do then. There was no other damage to my car before her car hit mine she woukd have to prove that there was? She has met her match.
