Renewing Car insurance problem

Hi,
So last year in December 2016 I had an accident where a truck turned in to me on M1 and wrote my car off. Someone came, assessed car and took my car away. Totally not my fault, had witnesses who backed me for that reason and after many months of messing around I got my excess back in April as the third party admitted full liability. I asked when I got excess back if everything was now sorted and I'd have my 2 years No Claims Bonus/Discount and she said yes everything sorted.
6-7 months onwards and it is time to renew, my insurance sent me a renewal by email with 0 years no claims bonus going from around £1200 monthly instalment total to £2200. I phoned up and explained that I got excess back and they admitted liability and she said sorry and re-quoted me with £1420ish (With Black Box). She then sent me the new renewal quote by email saying 2 years No Claims Bonus and said if you want to cancel then you got to ring atleast 5 days before due to auto-renewal. It is 20 days before renewal, I rung yesterday to say I want to cancel and because I wasn't sure if the new renewal quote classed as proof of NCB/NCD, I asked for proof of it on phone. He then said that he couldn't send me it because my claim is still OPEN...
After further probing why 11 month after the accident and 7 month after they admitted liability, it still isn't close, the claims team said it was because they haven't recovered full costs from third party. Reason being (after further questioning) that they haven't yet received pictures of the damage from the person who assessed my vehicle and took it away. And I wasn't happy that they haven't got pictures, 10ish months after the accident and they still haven't received pictures that were took a week after accident?? Even worse that they haven't bothered to follow up in last 6-7 months when they knew third party were admitting liability.
Anyways I wondered would I be able to use the new renewal quote I received for a new insurer if they asked me to provide evidence of NCB, I am worried they will ring my insurance who will be like no, he still has an open claim! It is just rather pathetic that they would send me the 2 years no claim bonus renewal but then laugh when I want to cancel so I'd be almost forced to renew with them to afford insurance! Any advice?

Yes, your renewal notice declaring 2 years NCD is usually sufficient for new insurers. Best thing to do is follow the MSE guide for cutting insurance costs, then phone whichever prospective insurer you want to take the policy with and double check with them (before you purchase the policy).0 -
So I should also explain to the new insurer that my claim is still open although the third party has admitted liability and I recovered my excess as a result. I feel like they would reject me instantly until it is closed. More Than SW trying to trap me within their company as long as possible it seems. :rotfl:0

If the claim is still open then it WILL be recorded as an "at fault" claim on the CUE database. Even if you use the renewal as evidence of no claims, the new insurer will likely check CUE at some point ... if they find this open claim then they'll adjust your premium AND apply an admin charge.
I know because it happened to my wife (I'm a named driver on her policy). I had a non-fault accident in my company car (someone reversed into me - it was captured on CCTV) in April 2016. Wife's renewal was in September 2016. December 2016 she got a letter about the premium adjustment, admin charge, and why. I followed up with my claims handler and he told me that the 3rd party hadn't yet paid the claim - that's why it was still open. It was eventually closed in March 2017 - 11 months after the accident - and only because I actively pursued it and kept hassling the claims handler.0 -
In some cases, e.g. where there is physical injuries, a case remain open for 3+years. However that is not relevant as you have notification from your current insurer that you were not at fault.

Insurers assess "fault" based on whose hand went into whose pocket.
Right now, your insurer is out of pocket, because while the other insurer have agreed their policyholder is liable, they have not agreed and paid the amount. So, no, you do not have currently 2yrs NCB, and you have an open claim on your record.
Even when it is resolved, you will still have a claim on your record, albeit not-at-fault.0 -

Insurers don't use the word "fault" to indicate "blame"!
(You can be entirely blameless in a claim eg. when you return to your car in a car park and find it damaged by an unidentified third party - nevertheless the claim is a "fault" claim as far as your record is concerned and disclosing it to other insurers for quotes is concerned)0 -
UPDATE OF ORIGINAL POST: So i did explain to insurance company I wanted to go with and he says im better of chasing it to get it sorted. So i did.. case closed a few days ago so I thought I'd wait a few days before i insure ready for renewal 28th Nov..
Then boom.. out of nowhere, another accident. I was on a roundabout and it hit traffic so all cars that entered roundabout had to stop for this traffic. Lucky me I was at back of this queue on roundabout.. mini truck comes around roundabout and smashes in to back end of my car coming at a slight angle as he was meant to be exiting from the exit, there was plenty of room to get through but the reason he said he crashed was because he didnt look around the roundabout at his exit (which sounds so daft to me, where else would you look if not around the roundabout and mirrors at very end)
Exchanged details. He says sorry 20 times but won't admit liability which is to be expected as he works for a firm.
My question is.. I rang my insurance to say i've been involved in an accident which i dont believe to be my fault blah blah and they said that I would get my car checked and sent for repairs and they'll chase third party but... I'll have to pay £650 excess when i get car back and also this means I am losing my no claims of 2 years because I am essentially claiming against my own insurance.
I wanted to know, is it possible to say you don't want the hire car or repairs done and then that would save the excess?
And also on top of that, get my insurance to still chase the third party for cost of repairs which will need doing eventually whenever they do recover costs.. is this a thing?
I dont really want to lose 2 years no claims as im 5 days from renewal and hadnt actually phoned and paid for new insurance at a new company.. but at same time I believe accident to be the third partys fault and therefore would like them still to retrieve costs to repair my vechile
