    If you don't claim off your policy then your insurer has nothing to pursue the other side about.


    If you are sure the other side is liable then you can claim directly from their insurer thereby not having any excess to pay etc


    (Irrespective of whether or not you withdraw your claim you must still now disclose this incident as a loss to any insurers you go to for quotes over the next 3/5 years depending on how long a history you are asked for)
