car sold to a trader and trader not willing to pay
Hi, I have sold my personal car to a trader (like we buy any car). The trader's franchise garage checked the car and bought it. They are suppose to pay me by bacs within 3 days. But they didn't. Instead, the trader has comeback after 3 days, saying that car has mechanical problem and not willing to pay the amount agreed. The trader is asking me to take the car back. I have already informed DVLA about the sale.
I have sold the car in good faith. I am not sure why after 3 days the trader is saying this. I was driving this car and it was alright. I am not sure why the trader is saying this. I need this money to buy a new car.
Please let me know what are my legal rights. What are the steps I should be taking? Please advise.

You have the right to collect your car.
Anything else depends on their T&Cs0 -
Well you could in theory take them to court for the money. I'm not saying you should do this, but it's an option open to you.0

I think a lot of these big online buyers are getting "caught" with cars that have severe mechanical issues that are not immediately detectable.
When i was trading i'd get stuff quietly traded in that would :-- Cut out at 70MPH (hard to check that on a test drive)
- Wouldnt start when cold
- Filled my yard with blue smoke when cold
- Had intermittent faults faults (i took in a beautiful top spec voyager that periodically just "cut out" when you were driving it. Not often, maybe once every three days)
I think in theory you could try to force the dealership to pay by going through the courts, but they will have the weight of their army of lawyers behind them and cast iron terms and conditions.
I'd take it back personally.0 -

Strange that... I thought it was just the garage that I worked at that had customers trade in their 'perfect' cars!
I know the blue smoke one only too well. Guy traded in a car - to be fair we only offered him £500 after a visual walkround. Next morning started it and it was like Brigadoon mist! the guy promised us it was mechanically perfect, what he did not tell us was that it was going through more oil than Ozzy went through vodka!

The trick is in figuring out what is wrong, you might hope it is just the balloon payment was too much, or the registration is "too old", but that is usually wishful thinking...I want to go back to The Olden Days, when every single thing that I can think of was better.....

Most usual reasons were :-- Need something bigger
- Need something smaller
- Need something younger
- Need a first car
- Need a second car
- Need something with less miles
- Need something more economical
- Need an estate car
- Need a people carrier
Very rarely did it subsequently transpire that it had actually been "need to get rid because theres a major fault i'm not telling you about".
BUT there were people who tried it on. Most times you could pick it up when you drove the car but sometimes you did get caught.0
