    For adults it's 20 minutes after a 6 hour shift.

    For 17 year olds it's 30 minutes after a 4½ hour shift.

    So long as she has her 30 minutes starting no later than 1.30pm it's legal.

    If that doesn't happen you have to look at whether that was a one off, or if the boss is actually a tyrant/breaking the law from arrogance.

    But, 30 minutes is legal. She benefits from not having to go the full 6 hours before getting that break and it being a bit longer.

    Some industries/jobs are exempt from these rules.

    It's still legal if she has her break at say 2pm as long as the break is not at the beginning or end of the shift its ok.

    And should be "around the middle". If it is to close to the beginning or end that is also not allowed.

    Some really valuable advice here:
    • what happened or happens in another job is irrelevant
    • Good practice for adulthood - let her ask her own questions
    • work is tough - join a union before you have problems, not afterwards

    I know you have the best of intentions in asking for her, but the minute she's setting for in the world of work, she's an adult - of sorts. Inexperienced, yes. But help her to find her own answers, don't do it for her. I see too many 40 year olds who haven't a clue - you can't learn soon enough how to survive in work, and how to get the right help.

    Breaks are usually unpaid and most people prefer to minimise time spent at work rather than have long breaks.
    When I worked as an agency nurse a couple of places had the brainwave of making our shifts longer by inserting an unpaid two hour break , which really annoyed me.
  • As a side note, your 17 year old daughter (I assume that's what you meant?) probably has little to no work experience and should just keep her head down

    I used to get a break after working 4 hours.I went to work as a Saturday girl in Bhs in 1983 and the supervisors used to watch these hours rigidly to make sure they didn't send us on too early a morning break plus the latest lunch.

    It became 6 hours before a break some years ago.

    When I was 18 I used to have a Sunday job working 16 hours from 7am until 11pm on my own and without a break, in a petrol station. I kept this job up even after I left college and worked full time Monday to Friday.

    Sorry I worded it incorrectly. You are right. If you're working more than 6 hours you get a break. As an adult I worked 9-3 and didn't get one.
