!must have been confused by the title of the thread - Civil Enforcement Ltd -!Help & Guidance needed please!which....strangely.....is the nature of my post?
Crazy how that happens.I will be sure to point others to this website for help and advise on situations like mine.Until then, thanks again and i will be sure to recommend you highly to others.
Good luck with your case. I think you've blown your toes off here.0 -
We don't need recommending, we're busy enough. We're happy to help anyone who comes here, and that's what we do. However, as we all have our own day jobs and lives (for instance, I have a full time job and am a single mother to 4 school-age children) we do hope and expect posters to make it easier for us by keeping their own questions on their own threads - there are currently dozens of live, recent CEL threads. All have their own distinct facts, albeit most have common issues (which is why we tell newbies to gem up by reading the other threads).
It gets highly confusing for different cases to be merged by dealing with them on the same thread. You're simply asked politely to set up your own thread. This is Maxbrum's. Maxbrum wants help and advice. If we end up giving it to others on his/her thread, Maxbrum's issues get "lost" and (s)he gets confused.
That is all. If you want to go off in a huff offended by our requests to abide by forum etiquette, it doesn't matter to us because the next poster will be along in 30 seconds. Likewise if you tell all your friends that we are not very nice, it doesn't matter to us. But anyone who comes here will get sound and invaluable advice if they make it just a bit easier for us.
If I was you, I'd get over yourself and start again with a new thread. You will get the help you need and you simply won't get better tailor-made advice than on here.Although a practising Solicitor, my posts here are NOT legal advice, but are personal opinion based on limited facts provided anonymously by forum users. I accept no liability for the accuracy of any such posts and users are advised that, if they wish to obtain formal legal advice specific to their case, they must seek instruct and pay a solicitor.0 -
Thank you kindly Umkomaas, your comments are both helpful and constructive.

If you found the advice I gave too difficult to handle, how on earth are you going to handle a PPC or (potentially) an adversarial advocate working for them in the county court.
Good luck. Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Hi Guys,
Finally received the POC today which is dated 11th Oct, 2017 and has a post mark of 1 Nov.
I have drafted the letter which i am going to send it to the courts and CEL, points taken from LOC123 letter which she had drafted for one of the posters here.
Can you please review it, and see if i have added the dates correctly.
Thanks for all your help and support in advance.
Dear XXXXX
Claim number [xxxxxxx]
I am writing to draw to your attention that the Claimant has deliberately backdated the Particulars Of Claim which were served separate to the Claim Form pursuant to CPR Rule 7.4(1)(b).
The Claim form was issued on 11th October, stating that the Particulars of Claim would be provided to me within 14 days after service of the claim form.
The further Particulars of Claim and covering letter were sent under cover of 1st Nov. As such, according to Rule 6.3(b) they were served on 2nd Nov, However, they were dated the 11th October. which means that my defense is therefore not due until the 16th November (Rule 15.4(1)(a)).
The Claimant has made a poor attempt to conceal the actual date on which it served the further Particulars by backdating them by 21 days, together with the covering letter. This is clearly demonstrated by the post mark on the envelope they arrived in, which shows the date of posting as 1st Nov, a copy of which I have provided as evidence.
The Civil Procedure Rules are quite clear – under Rule 3.8 the court should apply the santions unless the Claimant has applied for relief under 3.9.
I cannot fathom any reason for the Claimant having backdated its further Particulars of Claim, other than to try to gain an advantage by making it appear that I have filed my defence late, or by confusing me into having to rush to file my defence prematurely. This is a serious matter and I ask that this is formally noted on the court file.
This is a commercial Claimant pursuing many other claims of this nature. It must therefore have knowledge of, and understand, the Civil Procedure Rules and these sorts of blatant breaches should not be allowed because they prejudice Litigants in Person who are not versed in court procedures and the court rules. It is with some difficulty that I have understood the various obligations and time limits set out in the Civil Procedure Rules, as a Litigant in Person, whereas the commercial Claimant has no such excuse.
Yours Faithfully
If the POC were backdated and you kept the envelope that proved they were not posted when dated, PLEASE NOW forward the complaint you made to the CCBC, to another email address.
We need LOTS of these to fly into a specific inbox now:

Once that has been done, please confirm. We need to bombard the CCBC (specifically to Amanda Beck who is aware of this scam) with evidence about CEL.
Do this - even if you've already emailed a complaint - PLEASE forward it now!PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Hi Coupon - mad
I did complain to Amanda Beck and this is the email i received today. Seems like CEL will get away scratch free for this blatant abuse.
Any comments guys.
Good morning,
Further to your correspondence regarding the claim made against you, I see from our system that you have filed a defence.
The County Court Business centre is not able to deal with complaints against Civil Enforcement Ltd; if you wish to file a complaint then this should be made direct to Civil Enforcement Ltd. Alternatively you can make an N244 application to a District Judge. Guidance has been attached along with the Help with Fees guidance.
Please note Court staff are not legally trained and cannot provide legal advice. If you are uncertain how to proceed, the Civil Procedure Rules available on the Ministry of Justice website provide details. On many occasions it is best for people to seek professional legal advice from a solicitor, legal executive, legal advice agency or Citizens Advice Bureau. You can also contact Community Legal Advice for free on 0845 345 43 45 or via their website.
Regards,
L. Webb

Read the last 2 pages of this thread. You need to be all over these CEL threads to be bang up to date every day - otherwise you’re in danger of missing important information. Don’t isolate yourself within your own thread.

You guys are doing amazing job, please keep up the good work.0 -
