MET Parking charge notice

Hi
been sent a MET parking charge for staying 20 minutes longer than should have in a Mcdonalds car park. They have supplied two vague pictures of the car entering and exiting the road.

have just found this forum and read the newbie facts as well as some of the older posts, but am still confused as to whether there is a need to appeal since a law change, or if it can just be ignored and the letters will stop.

Please could someone help me with straight forward instructions, as I suffer from Aspergers Syndrome and find this type of stuff very confusing to deal with.

Thank you for taking the time to read this.

Read them again, I believe that they are as straightforward as you will find anywhere on the 'net.

    1. Remove any reference in your post above as to the identity of the driver.

    2. As the registered keeper, it is your wife who is being pursued. She must deal with it as the keeper, although you can do the paperwork, but everything in her name.

    3. The latest ‘change in the law’ you refer to is now over 5 years old. Everything in the NEWBIES FAQ sticky has been written since that date and set within the context of that law - Protection of Freedoms Act 2012.

    4. Send the PPC the blue text initial appeal from the NEWBIES FAQ sticky, post #1 by their deadline and by precisely the instructions they give you in their NtK (including name and full address of the vehicle’s keeper).

Finally, this isn’t a ‘painting by numbers’ simple process, there’s lots of research and drafting to be done in the run up to Christmas, so if you’re going to struggle with that, the forum doesn’t have the resource to do this for you. You need to rope in someone near to you who can help you go through everything.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

  • Thank you for the quick reply, I really do appreciate it.
So I do have to appeal and cannot just ignore the letters as in older cases?

I have read the Newbies facts but just found it confusing, especially the abbreviations.

I just didn't want to appeal, if I didn't need to or, if it was the wrong thing to do and gave them more to pursue me with.

    Thank you again.

Nearly all of these so called breaches of contract damages are in fact scams. They use threats and half-truths to part the poorly educated and vulnerable from their money, but stand up to them and you can not only not pay them, but cost them money.

As Umko says, it is not a walk in the park, but it is not rocket science either. It is well worth fighting and you may learn a bit about the law in the process.

    Thank You

I will use the template set up in step one as advised above.

So someone can appeal, even if someone overstayed as the parking fine is a scam? I am just wondering or would they need to provide evidence of their innocence?

You need to research and read about all the reasons why this charge is not sustainable. You have to learn the game you’re in.

But despite my very first piece of advice about not identifying the driver, you are falling at the first hurdle. Please do that and don’t repeat it.

  • Sorry,

So is there anywhere I can go to research this, other than these forums? I have searched the forum but everything is already to indepth and people who already know a lot of the ins and outs.

Specifically the MET Parking service, so I can relate it to the PCN received?

I do appreciate people taking the time out to reply to me, I am sorry if I am coming across as ill informed.

You will find almost everything you need to research in the NEWBIES FAQ sticky. You won’t be able to take all this in overnight, it will take a few reads of the sticky (as well as searching for other MET/McDonald’s threads as the way to deal with this is widely detailed in those).

For the moment though, you need to get the blue text initial appeal from the NEWBIES FAQ sticky, post #1 off to MET. Do that immediately if it was an ANPR captured parking event, or around day 25/26 after the date of the event if a windscreen ticket. All described in that section of the sticky.

There is nowhere else even vaguely recommended for private parking matters, except the BMPA:

    http://www.bmpa.eu/companydata/MET_Parking_Services.html

Not quite sure what advice you are looking for. We do appeals. We win appeals. It's only MET, a firm who never sue anyone (the BMPA tells you that) and even if an odd case is lost at POPLA, no-one here PAYS. This is not rocket science.

Do NOT follow advice from any poster who has just joined, nor anyone who sends you a private message offering to help, or (perish the thought, but some people are clearly desperate) touting for business.

Finally, why are the acronyms confusing when post #5 of the NEWBIES thread decodes them?
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

but everything is already to indepth and people who already know a lot of the ins and outs.

By not following their terms and conditions you have breached your contract with them and they want £100 damages. It is a scam and judges tend to frown on such practices, but they use low-rent solicitors and will take you to court. Many peiole cave in and pay them.

It is a complicated subject, there is no dummies guide. This forum is as user friend as you will find. Either learn the rules and join inhen game, (for that it what it is), or pay the charge. People come here not knowing the difference between a County Court and a Crown Court, put in the hours, and leave winning their cases against barristers. You can do that too but you must stop looking for a silver bullet.
