    I had my notice of allocation from my local court last week with a hearing date. In the post yesterday I received a letter from CEL notifying me that they have cancelled proceedings and a copy of the N279 form they have sent to the court. Is this unusual? If this entirely good news? It seems like good news.

    Just all part of the nutters syndrome with CEL
    They knew they would lose.

    Just confirm with the court ..... then it's all over

    CEL are such timewasters:rotfl::rotfl:

    Yes Good news
    the N279 form should also be filed with the court.

    You could email this copy to the court requesting confirmation that they have received this.

    Brilliant. A result. I'm very pleased. A result which is entirely down to the help I received on this forum. Thank you.

    No problem, it's why we come here, to beat this scam! Same as this one:

    This is what happens in all CEL cases when well defended, just wish more people knew that!

    Two things to now do to fight back, if you haven't already:

    I've just emailed my MP asking him to support the bill, he's very good at replying although he'll do so by post. I'll post here when he does and let you know if he's going to support the bill.
  • A discontinuance leaves open the issue of costs.

    You could try writing to the court to ask for costs, and say there's no need for a hearing. It's worth a try, but you may decide you just want to forget about everything now! Have a look at peperlini's thread which contains a precedent letter to the court, skeleton costs argument and costs schedule, and an offer letter to CEL. You will obviously need to adapt the factual matrix in the Skeleton so it applies to your individual circumstances (eg if your claim was post-1 October it's not just parts of the old PD which apply to you but also the new Protocol for Debt Claims).
    Although a practising Solicitor, my posts here are NOT legal advice, but are personal opinion based on limited facts provided anonymously by forum users. I accept no liability for the accuracy of any such posts and users are advised that, if they wish to obtain formal legal advice specific to their case, they must seek instruct and pay a solicitor.
