Thank you very much indeed. I'm re-drafting my defence statement now.
And yes, the PEL reference was a mistake.
This defence is in an envelope and will be in the post tonight.
Thanks again.0 -
get a certificate of posting from the post office counter, it's free.Although a practising Solicitor, my posts here are NOT legal advice, but are personal opinion based on limited facts provided anonymously by forum users. For the sake of a couple of quid I'm going to send it registered/special delivery/whatever they call it these days then I get proof of delivery as well as postage. It's never been about the money (although obviously I'd rather not have to shell out £350+) it's the principle of it that really get me on this. These people are charlatans. It's not a business model, it's extortion.0 -
I think you can email it to ccbcaq@hmcts.gsi.gov.uk.
You will have to sign your defence statement, scan everything, save as PDF and email it as an attachment. Put your Claim Number in the Subject field. For the sake of a couple of quid I'm going to send it registered/special delivery/whatever they call it these days then I get proof of delivery as well as postage. As per Dolly Dee's email the signed defence statement can be emailed to the court directly.
she has provided you with the email address to do this and again this is
ccbcaq@hmcts.gsi.gov.uk
You will need to put the Claim No in the subject field and put
"Defence Response" -CEL (Claimant) v (Your name) (Defendant)
I would suggest you cc yourself in the communication with a short email confirming this, highlighting the late particulars of claim received.
Make sure of course you attach the Defence.0 -
I wouldn't bother with recorded delivery to the court. And we always recommend no recorded to PPCs because they often refuse to sign and then you're a bit stuffed.
Either just post with certificate of postage, or email it.Although a practising Solicitor, my posts here are NOT legal advice, but are personal opinion based on limited facts provided anonymously by forum users. I don't have the facility to scan the signed documents here. If I did that'd definitely be easier.0

Actually. I don't need to. Had a quick Google and found some online guidance hereIf you are filing a document by email that contains a statement of truth you are reminded that you should retain the document containing the original signature. The version of the document which is filed by email must satisfy one of the following requirements:
(a) the name of the person who has signed the statement of truth is typed underneath the statement:
(b) the person who has signed the statement of truth has applied a facsimile of his signature to the statement in the document by mechanical means
I've added my name to the bottom next to the date rather than a signature and emailed it off.
Thank you all for you help. It's been brilliant.0 -
Just a quick update on this in case anyone else was wondering. When I emailed my defence over (as a pdf document) I followed the guidance I quoted/linked to in the post above and just typed my name above the date after the declaration of truth. I got an automated reply to the email and it showed my defence had been filed on MCOL the next day.
I've received a letter from CCBC today informing me my defence has been sent to CEL and they've got 28 days to decide if they want to proceed.
It seems that if you don't have a scanner to scan a signed document, it doesn't matter.0 -
If the POC were backdated and you kept the envelope that proved they were not posted when dated, PLEASE NOW forward the complaint you made to the CCBC, to another email address. Or if you didn't email a complaint please do so now to add to the pile we are creating this week - it's vital and may help your case to be struck out in the end.
We need LOTS of these to fly into a specific inbox now:
https://forums.moneysavingexpert.com/discussion/comment/73400735#Comment_73400735
Once that has been done, please confirm. We need to bombard the CCBC (specifically to Amanda Beck who is aware of this scam) with evidence about CEL.
Do this - whether you have or haven't already emailed a complaint - PLEASE...!PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
