Aquacard offer: who is right?

Three months ago I signed up via the MSE link for the Aquacard Advanced card to get the Amazon voucher offer. The terms were basically you had to use the card at least once in the first 2 months, always pay your card balance off on time and stay within the credit limit.

As I was just using this card to get the voucher I used the card once in the first month. I then, since I wasn't going to use the card again, waited until the payment showed up on my online statement and paid it off. I didn't set up a direct debit, and the payment was made well before it would have been due.

Aquacard are saying I do not qualify for the voucher as I should have weaited tro get my statement then paid it off. I don't think this matters. In fact, this was there second attempt at explaining why I would not receive the voucher. At first they explained that the terms were that at least one transaction mustr be made in each of the first two months. I told them this was not in terms I signed up with and either MSE is wrong or you are, and I'd bet it's not MSE that is wrong. They then changed their argument to the one I describe above.

Do you think I qualify for the Amazon voucher? If I do, how do you recommend I proceed?

    Escalate to the FOS if they continue to disagree.

    You'll almost certainly win, eventually. But next time wait for the statement before you pay.

    Their customer service line is so bad, it takes for ever to reach an agent. I asked to cancel my card after I was told they would not give me the voucher. Does this affect my ability to complain?

    No, but you may have dropped down the queue in priority.
  • Tried calling again, this time given a different reason I wouldn't be getting the voucher. It looks like a clear policy of not honouring the offer to customers who are not going to be longterm profitable ones for them. This is clearly not legal. Letter sent to FSO.

    Anyone else been denied the Amazon voucher after meeting the criteria?

    FSO ?

    Do you mean FOS (Financial ombudsman service) ?

    You will need to have received the credit cards companies final response before you can escalate this.

    then my reading of the t and c's is that you needed to use the card in each of the first 2 months to qualify

    In which case the complaint will rightly fail.

    What MSE says (or said) is ultimately irrelevant, as the terms that matter are those between you and Aqua - MSE's role is simply directing traffic to Aqua and in emails/articles/blogs will always have to summarise key terms, which clearly won't be the definitive ones.

    So if you have a copy of what you signed up to with Aqua themselves (rather than an MSE summary of that) then it should be straightforward to establish what the rules of the game were when you signed up....

    In the link posted above that everyone agrees I did not meet the terms can someone point to where the terms are. The only terms I see are near the bottom and stated below but these obv aren't the terms you are referring to as they state no place that the card must be used in each of the first teo months. Im not diagreing in fact it would be good to know I am wrong and can forget about this.; It is still strange MSE still advertises the card with affilaite link and says make one transaction in first 2 months only. I know MSE affiliate ad has no legal basis but MSE is a trusted site, at least I trust it.
