Underlying contribution esa

Hi i need help please i have rang esa and carers 25 times i get income related esa myself it was just changed over from contribition based now this is the problem i still have a underlyning entitlement of contribution based esa but i dont get a payment of it i only get income related with contribition based underlying now i claim carers for my 5yr old son its underlyning carers no payment but now my esa as changed to income related i was told i can get a payment of carers now esa are telling carers i get contribution based esa because its underlying but are telling them that i recieve no payment its only underlyning my payment i recieve is income based.but esa and cares are saying because i have a underlyning entitlement to contribution based i cant have carers but i dont get a payment for it i only get income related could anyone please help surley i cant have underlying carers and underlyning esa but get get payments for none.

Which group of ESA are you in? Support group or WRAG?
What triggered your claim from contribution based ESA to income based ESA?
If you still have contribution based ESA with an income based 'top up' then you can still put in a claim for CA but you wouldn't receive it. Instead you would have an underlying entitlement to CA and a Carer's premium ( about £30 ish a week) which should be paid with your ESA.
But you have to put in a claim for CA to receive the Carer's premium.0 -
Hi im in support group my trigger was a call from carers to ring esa and change to income related as they can pay me what im owed as i was not getting any premium in my esa either and i had been on contribution based for 2 yrs.So i applied to have it changed which they have i now get carers premium and income related esa which is a total of 160.I have a underlyning carers claim for 2 yrs.but they now saying i still cant get a payment of carers even though i am now on full income related because i have a underlyning entitlement to contrbution based if though i get no centribution based payment.0

It is possible to be entitled to contribution based ESA and also meet the criteria fir income based ESA.
Contribution based ESA will always taken precedent as it is based on NI contributions.
Premiums cannot be paid on a contribution based claim so what they have done is assessed you and found you also meet the income based ESA criteria.
This is usually referred to as a contribution based claim with an income based 'top up'. Although the DWP refer to it as an income based claim you still are being paid your contribution based ESA within that claim giving you the underlying entitlement. Because of this you cannot actually receive Carer's Allowance because they are overlapping benefits.

Thankyou.I have just rang carers to see what the note says thats been left on the system from esa to carers and it says i am getting income related but have underlyning contribution based it says no part of my money is contribution paid and that i am entitled to 109 contribition and 109 income related but they are paying 109 income related no part is contribition based.0

Are you being paid the Carer's premium and the enhanced disability premium with your ESA?
Look on your award letter and it should tell you.
Please tell us exactly what it says about your award and the figures.
I know you have a child. Do you and your child live alone?
Do you receive DLA or PIP?
Your ESA is contribution based and income based. They are correct and you can't receive any payment of Carer's Allowance.0 -
I get dla high care so does my son we live alone.i have a carer who does not live with us so my disability premium doesint get paid.my esa award says this exactly living expence 73.10 extra money because you are a carer 34.95 disability income guatantee 15.90 support group 36.55 total income related amount 160.50.your total imcome related entitlement os 160.50.that exactly what it says.0

Esa said on phone which it doesint state on the letter the contrbution based is underlying for future incase i come off income related i dont get any contrubution based money in my payments.0

You are getting ESA as follows:
£73.10 Personal Allowance
£36.55 Support Component
£15.90 Enhanced Disability Premium (called 'disability income guarantee' on the letters)
£34.95 Carer Premium (Because you claim Carer's Allowance underlying Entitlement)
TOTAL = £160.50
Within your ESA award you have the following which are ESA Contributory:
£73.10 PA
£36.55 SG
Total £109.65
Because you have ESA Conts entitlement and you are in the Support Group...You will always have ESA Conts £109.65 ...for as long as you stay in the Support Group. You cannot get rid of it. It will always be there. And it gives you certain perks, which you may or may not need/get but they are available to you none-the-less.
Because you have ESA Conts included in your ESA award...When you claim Carer's Allowance...Carer's Allowance will not pay you anything and will be called "Carer's Allowance Underlying Entitlement".
Both ESA and CA are correct, however, ESA is not explaining this very well to you.....it is not Underlying ESA Conts that you have... there is no such thing.... You have ESA which includes
£109.65 ESA Conts (which is a taxable income) and
£50.85 top up of ESA Income Related (which is not taxable income)
Your letters will say "ESA Income Related £160.50" because that is just the way they are written. But it is actually as I have shown you.
Now then.....incase you think you are missing out on something....I will explain....If you were not entitled to ESA Conts..your claim would be 100% ESA Income Related and Carer's Allowance would pay you £62.70 a week.... and your claims would look like this
ESA
£73.10 PA
£36.55 SG
£15.90 EDP
£34.95 CP
Sub Total £160.50
Carers Allowance of £62.70 would then be deducted as "Other Benefit"
£160.50 - £62.70 = £97.80
TOTAL ESA = £97.80
TOTAL CA = £62.70
TOTAL INCOME = £160.50
So you see, you would have exactly the same amount of money whichever way it was done.... But you have ESA Conts so it it is done the first way above.. and you have those perks of conts if you ever need them.
If your carer is being paid Carer's Allowance to care for you,,,then you cannot get Severe Disability Premium (SDP) on ESA
If your carer stopped claiming carer's allowance or
If your carer was to get Underlying Entitlement to Carer's Allowance (same as you do)
Then you would be entitled to get SDP on ESA.
SDP is £62.400
