    It's not Santander's logic. That is what the regulations state.

    But your argument is that the purchase relates to a wider purchases which you are benefiting from.
  • The receipt I received from Monarch is in my name, it was my card. I paid for my son to join me on holiday. Just because his name was on the boarding pass doesn't mean the chain was broken and he became the 3rd party. If that's the regulation then it's crazy. Are you saying that anyone buying something for another person with their own card would not be protected because the goods weren't for them ??!!

    Correct.

    Which is why you just need to state that your son's flight was part of YOUR holiday. It shouldn't be a problem.

    On monarch cca website go to refunds click package deal etc & there it a link to a form to fill in your details if you have not received a claims form

    There are so many variables for customers with Monarch bookings. If yours is a package holiday then you should be ATOL protected for the debit card payment but if its flights alone then RBS should progress a chargeback for you.


    A S75 claim with M&S will probably only be successful if you show you have exhausted your other options and that RBS were actually correct to not offer a chargeback.

    The flights are not covered if booked after December 2016. I am flight only not a package.
    You may have misunderstood - a flight-only Monarch booking made after December 2016 isn't covered by ATOL but this doesn't affect section 75 eligibility, and other avenues such as travel insurance or chargeback are potentially still available too, see https://www.moneysavingexpert.com/travel/monarch-airlines-collapse-latest-info-and-your-rights#flight for further details....
