Bully not moving

Everyone in my team bought a bullying grievance against our supervisor, and the grievance was upheld.

He has shown no remorse and made no apology, but is now refusing to move. It's very clear from what went on that nobody in the team can work with him again, mediation has been tried in the past and brought no improvement. It's not possible to move everyone else from the team, so what on earth can be done? It's making everyone ill and the whole process has now take almost 2 years with no visible end.

    Then it is up to the line manager to ensure his request has been carried out. If not the LM will make himself look very weak, unless the supervisor has persuaded the LM that the reasons for him staying outnumber those for him going.

    Having had 7 separate counts of bullying upheld, what could possibly be the reason for him justifying staying? Also, if this is relevant, pretty much the entire 7 of us are very high performers (regularly reflected in feedback, appraisal etc) and he is not. He struggles with everything and this has been admitted by his manager to us in a careless moment.

    What legal grounds has he got them on that they can risk ruining a good team? I thought if someone were moved to a post with equal pay/conditions etc there's no grounds for complaint? There is another team he could go to on those terms, although I pity them if he does! And if he stays put, I see all of us wanting out.

    Only his LM can answer these questions. Not knowing the hierarchy of your workplace or the politics, it is difficult to offer suggestions. I doubt there is anything in employment legislation which says someone who has had a grievance upheld against them for bullying has to be moved.

    If you all start leaving then the bully has in effect "won".

  • Do you know why they're not just saying to the bully "You've got two choices = move to where we tell you or we'll sack you. You have one week to make up your mind which it will be"?

    Yes, move to another team. No, M2stm, I don't know why. I know the manager is weak and distant and not known for doing anything decisive.

    I just wonder what if anything we, the team, can do. Without going into detail, the bullying was so bad we just can't work with him ever again. That should be very obvious to managers who know the detail.

    Can ACAS help your employer bring this to a satisfactory conclusion.

    If your manager is weak & indecisive then all I can suggest is that you go over his/her head. What are your HR department doing?
    Seen it all, done it all, can't remember most of it.
