Hi all. A friend just received a parking charge notice through the post from Parking Eye? The letter They have received is the standard one I presume, with a photo of a car entering and exiting the free car park at a local Asda. The letter states The car was there for 3 hours 54 minutes and users are only allowed 3 Hours. Now what they are trying to find out is.... Is there a certain time frame they should have issued this letter within ? The alleged offence took place almost FOUR MONTHS ago and this is the first they have heard about it. Any replies are appreciated. Thankyou.

    there are dozens of similar "golden ticket" instances on this forum , its become a daily occurrence , so if you search there are plenty of threads you can read, all with the same questions and same advice and most of that advice is from me and other regulars on here

    never blab on a public forum so edit your post accordingly , because like they say in cop shows

    "anything you say may be used against you in a court of law"

    and the other people affected rarely read the other posts like yours , so they never reply because they get the same advice and do it and dont bother coming back

    my advice stands , edit your post and use that appeal I linked in the other thread , as keeper

    if they fail to cancel, you draft a standard popla appeal and let popla cancel it

    also I would complain to ASDA head office (in LEEDS) on their main website by putting a complaint in and getting them to cancel it

    you must do as you see fit but it doesnt matter if anyone else has had first hand experience of it because I have told you what you need to do to get rid of it seeing as you appear to have a "golden ticket"

    but the correct reply was

    "thanks redx, I will edit my post and do exactly as you have said seeing as you know what you are talking about"

    I have been reading the stuff you told me to but all the references to paragraph this sub paragraph that etc etc just absolutely lost me to be honest. I will just presume that they don't have to issue the Parking Charge Notice letter within a certain amount of time from the date of the alleged offence, and My mate will just pay up.

    you would be 100% wrong then on all counts because as I told you earlier, its 14 days to issue a notice to keeper, which is what you received , albeit months late

    paying them means they get to sc@m old ladies and the disabled and disenfranchised when you have a perfectly good case that is easily winnable

    spell GUM backwards on your forehead , then look in a mirror

    OMG just read the NEWBIES thread, post #3 shows you a Golden Ticket (linked picture of one) and tells you that you CANNOT LOSE at POPLA. You appeal this as keeper (not driver), you WILL win.
    The letter will go in the bin then as they have obviously not followed correct procedure.
    So you'd rather they sue you, than simply kill it off with 2 appeal template stages? Already covered in the Sticky thread?

    You are joking, this is the easiest one to appeal in the entire World and you want to bin it and let PE sue you.

    I did , to the person in that other thread which I had just replied to

    you dont seem to want to do any work at all

    ok , bin it , but I can assure you that if you do so you will be in the small claims court and losing like BEAVIS did 2 years ago and then you will wish you had read and taken note of what people are telling you

    this will cost you about £175 and a CCJ if you fail to pay the judgment within 28 days

    you are stubborn and foolish and you will regret it in time

    clearly you asked for help and advice but you would rather argue about it instead of doing what we have said

    a fool and his money are soon parted

    ps:- the letter states that THE VEHICLE was there , not the person, so post #1 is still blabbing

    this is what trebor1955 was told in that other thread
    edit the above to remove any hint of who was driving or may have overstayed

    the DRIVER may have overstayed, nobody else

    they have 6 years to send an invoice , but if they wish to use POFA2012 they had 14 days to send it, so they failed POFA2012 and cannot hold a keeper liable

    they have 6 years to pursue anybody who blabs about being the driver

    Posters are expected to do at least some of the research themselves. The information you want is already in the NEWBIES thread which is stuck to the top of this forum and asks you to read it first before starting your own thread.

    This is a busy forum and the regulars don't have time to spoon feed everyone that comes here. You asked a question that we get asked over and over again, even though the information is already available in the hope that it will stop us having to answer the same questions over and over again.

    Some regulars may spend time to answer specific questions whereas some will tell you where to look and then move on to help another poster.
