Plevin Dates - Please HELP!!!

Options
Hi,

I had a credit card from 2002 to 2012, and I had PPI on this card from the start until ~Sept 2006. I have tried to reclaim my PPI in a standard claim and it was rejected, but do I qualify for claiming under the new Plevin type of claim?

The dates say that to qualify, the loan has to have been:

* Taken out before 6 April 2007 but still active at some point after 6 April 2008
* Taken out after 6 April 2007

Well my was taken out before 2007, I cancelled the PPI in 2006 but the card was active until 2012 (although the PPI stopped in 2006). What are peoples thoughts?

Thanks,
Simmo

The PPI was cancelled in 2006, so no longer active in 2008. Seems pretty clear to me!
  • Hi Simmo,
My thought = just whack in a claim and see what happens. What's the worst that could happen = you get knocked back because of the date limitations ... or maybe you get lucky ? What have you got to lose other than a bit of time and the cost of a stamp ?

Not a good idea to send an obviously invalid claim, especially when all this kind of action does is clog up the Bank's complaint handling for those with legitimate complaints.

How will he get lucky if his complaint is not valid?
  • I proactively got a letter from Tescos regarding a ppi claim that they rejected. They specifically mention that I could claim again due to the fact that the commission was so high.

Anyone know the fact that Tesco sent me a letter means they are more likely to pay out? Any ideas of timeframe or also how much I could get paid? My loan was 5k over 5 years if I remember.

You'll get a refund of any commission you paid over 50%. Only Tesco know if you paid over that amount.

Banks are currently swamped with Plevin complaints, so I wouldn't be too impatient if I were you.

Remember that your mis-selling complaint failed, so you won't be getting a full refund of your PPI.
  • okay thanks.. for other ppi I have received then does that mean I can ask for commission parts to be reinvestigated again? Although I settled for the ppi non commission portion already?
  • No. .

Since successful PPI complaints garner a full refund of all PPI paid, Plevin doesn't apply.

Plevin only applies to rejected complaints...
  • Hi,

Thank you for the replies - some more useful than others!

I obtained further legal/financial advice and it IS worth putting a claim in, as although the PPI was cancelled the credit card was still 'open' and therefore I am entitled to make a claim. So, as the 'Money Saving Expert' recommends it is worth putting a claim in even if you do not think you are entitled it, you don't know until you try and you will never know if you don't try (and potentially not get a payout that you are entitled to!).

    Thanks!

If you didn't pay PPI, you won' get anything back.
If you complain and were successful with your complaint, you won't et any extra as a result of PLevin
If you complain about the same PPI twice, you won't get anything more back
