Carphone warehouse wont cancel contract

The day before yesterday I went and bought a new mobile. My Carphone Warehouse contract had run out years ago and I was happily just paying for my usage to 02. When my old phone gave up I had to go get this new one. The next day I realised it would be better for me to buy the phone up front from CW and continue my contract with 02. CW say I cannot cancel my contract with them as I arranged it in the shop and not on line I do see that they say this in their t&c (which he told me not to bother reading its just bumph). 02 tell me that I should be able to cancel anything within the first 14 days but CW wont do it as they say it was an upgrade. He also told me that i had 14 days if I changed my mind. Anyone else been in this situation? Is there a solution?

There is no right to cancel because of change of mind for contracts signed in store.
You should have signed up over the phone or online if you had wanted a 14 day right to cancel...====0 -
