    I'll post it as soon as I receive it in the post. I have a draft defence together already in this post, I need to get a copy of papers submitted to ther court and amend my draft BUT..

    I really don't want to go to court again, it's causing me too much stress and don't think I updated my DVLA documents so will probably lose on that subject. Is it right in saying the claim is back to it's original stage now so I can just pay the fees directly and be done with this?

    Open to any advice on what to do!

    Failing to update the DVLA is why you don't get your set-aside money back. It does not mean the original ticket was valid.

    If the judge thought that, he/she would have suggested that you pay rather than have another hearing. The courts are hard pressed and the last thing a judge wants is someone with no defence using up time. You appear to have convinced him/her you have a defence.

  • Phoned them and the operator didn't seem to care or want to help. I'm going to try again in the morning. She said if I was at the hearing I would know what the order was.

    Just worried about missing any dates. The only thing I can remember is the judge saying about submitting a defence within 14 days, but I was so overwhelmed with it being set aside I zoned out, expecting to be able to get a written copy.

    I assume I can just call the court and get a copy of all of the case documents, including the claimant's documents they sent for the hearing which I didn't receive either, but will they arrive in time?

    Also, should I seek a lawyer at all?

    A lawyer cannot help you, and you cannot get your money back for them

    Just state you would like a copy of the order as you can!!!8217;t recall what was said, and haven had a paper copy.
