Mortgage PPI claim, with or without my Ex?

Hi All,
Looking for a bit advise please . I applied for a mortgage back in 1995? right to buy with Lambert Building Society who no longer trade. I understand it was then Portman and now Nationwide. When my ex and I applied for the mortgage, they said because he was working for a care agency his work was not classed as permanent and the mortgage application was out through in just my name. I added him on to the mortgage there and then but the main application was in my name. We took PPI as a no choice option, they said being just myself on the mortgage we needed protection in case I lost my job and being the main applicant. If i recall the mortgage was about 75%. Anyhow we tried to make a claim when the care agency he worked for closed and he was made unemployed. When we tried to claim they said it didn't cover temporary employment status and they didn't assist with the payments. Since then we split around 2005, and sold the property and moved our separate ways, I understand he now lives in Australia. I want to make a claim for PPI mis sold as I wasn't told it was an option but also when we tried to use it we were told it wasn't applicable for his job status. Do I need to put his name on the application? Is he actually legally responsible for that mortgage even though my name was the main applicant and he was just added to the mortgage? Can I make a claim in my own name and not have to list him?
Any feedback would be a great help
thanks
Clare

If it wasn't an option, then it wasn't mis sold.0

If I had no choice but to take the PPI, how is this not mis-sold? PPI is supposed to be a choice, i was told I had to have it in order to get the mortgage.0
-
If it is a condition of lending, it cannot be mis sold.
It is only a choice it is presented as an option.0 -
Oh ok, how can they make it compulsory then? This was my first mortgage, how do I know if there were not just saying it was compulsory to make me buy it?0
-
They can make it compulsory by having it as part of their lending criteria.
If you think it wasn't a condition, then you would put that in as your complaint. If you have something in writing that says it was, they will check it against their criteria.0 -
I have nothing in writing but should they? Even so when we tried to claim they said we couldn't as he was in temp employment but the PPI was in both names? I am not sure if the actual mortgage was in my name or both?0

It sounds like you need to go back the beginning and find out who actually took out the mortgage.
However, I notice that the lender is no longer trading, which means you also have no one to complain to, unless the subsequent owners took on liability for any PPI mis sales.0 -
I thinks its Nationwide dealing with Lamberth claims now. I know I definitely took the mortgage in my name, the application and added him as in his name to it. They would not consider his earning at all working for an agency so it was just in my name. That was my question, with him being just a name on the mortgage, do I need him to make a claim with me or alone? Considering they refused to pay out when we did try to use it, it wasn't applicable for him. I will try asking around for some more advice. Being so long ago now I have no paperwork at all.0

What paperwork do you think Nationwide will have for a product not even sold by them 22 years ago?0 -
not sure? If they do not have any paperwork then I should maybe just put in a claim stating I added my ex to the mortgage when taking the PPI and when he tried to claim they said he couldn't make a claim. So the PPI wasn't not applicable for him thus being mis sold?0
