2x court claim forms

Hello. i have received court claim form through my door 14 days ago

1. claim from Gladstones Solicitors (uk car park management limited) demanding i pay £245 for breaching t&cs on the land dating back feb 17. i haven't responded to any of the letters they sent out. i have checked with car park no signs anywhere in the car park to say its permit and car park is no longer operating as business has gone bankrupt - gates to car park shut permanently. car stayed in the car park for no longer than 10 minutes.

Appreciate some advice.

    firstly , as these are separate claims you need 2 threads , so alter this thread in post #1 so it says the name of the PPC and Gladstones COURT CLAIM

    copy and paste the second one into a new thread with CEL COURT CLAIM as its header and then delete that part in your initial post

    that way you dont get confused with any replies (and neither do we)

    so 2 claims , 2 threads , each one separate

    do the AOS online on the MCOL site as per the BARGEPOLE instructions in post #2 of the NEWBIES sticky thread

    read that post and links for other advice too

    then start to draft 2 defences by reading RECENT court cloaim threads on here , plagiarising those defences to form your own defence for each one

    there are plenty to read and to copy from

    post each one in its relevant thread for critique when you have drafted them

    Hi,
    This one has gone against me due to not receiving court date letter and gladstones turning up. I am in 2 minds now do i pay the £265 fine to gladstones (I only have until 28th feb to pay otherwise i get ccj) or pay £255 for a NC244 form (if i go with this option can i claim back)

    PLEASE HELP!!!!
  • the question is , why did you not get the court date from court ? have you moved or anything , have you rung the court to ask how and when they sent them and to what address?

    Same address i just didnt get a court letter. they only gave me one option if i dont want to pay fine is a nc244 form which costs £255
  • then you go to court pay the £255 , and state no paperwork recieved , and ask for it to be redone

    I suspect wrong address , thats why gladstones sent someone

    People who disappear, are likely to take their eye off the ball & lose. Seen it time and again.

    After you sent your defence, you must have got a Directions Questionnaire from the Court, and you MUST have sent that back, nominating your local court, or you would have lost earlier.

    Then you would have got a Notice of Allocation (or maybe two letters) which gave you the court date, the fact it was now local, and the date by which to file your WS and evidence.

    Even if you didn't receive that, the BIG CLUE would have been Gladstones sending your their WS and evidence, and I would have expected to see you back here for advice all the way.

    So, what DID you get and what DIDN'T you get, out of all the things I just listed? And why didn't you act when you received Gladstones evidence & WS, knowing from the NEWBIES thread that this meant the hearing was near?

    perhaps they went to wrong address by accident (stop laughing at back)


    ASK the court WHERE the letters were posted to

    I received the first couple of letters through the post from county court which i responded and counter claimed, then i received email from gladstones with witness statement then heard nothing after that
  • so , go and ask the court whern and where the court date was sent to
