Broadband mis-sold ?

Anyone heard of this? Let me explain ....
When BT updated their network to fibre in my area I was keen to get a decent broadband service. I'm about 4 miles from the nearest exchange so I'd been lucky to get 1 MBPS on the copper wire network. Infinity 2 offered "up to" 76 MBPS whilst Infinity 1 offered "up to" 52 MBPS. When I signed up, I don't recall being asked which version of Infinity I wanted, I was given Infinity 2. This was about 4 years ago and I've been with BT ever since
Been looking around recently for a better price and EE looked attractive - when I put in my postcode their site advised the maximum speed available would be 38 MBPS. This surprised me so I went on the BT site and did the same check and it advised 40-50 MBPS. A speed check revealed I was currently getting 47 MBPS.
So, I've been paying a premium for Infinity 2 [speed up to 76 MBPS] but in reality the infrastructure could never achieve close to this to my property. I'm thinking BT should have known this and told me there's no point in paying for Infinity 2 when Infinity 1 would still provide a speed "up to" slightly more [52 MBPS] that the fibre to my property could achieve.
Do I have a case to complain to BT and ask for compensation?

How did you sign up ??
You can ask BT but they are going to say you should have complained four years ago .
Its possible that when you signed up the line was capable of over 38 meg ( Infinity 1 at the time ). The UP TO 52 meg is a newish service it was up to 38 4 years ago so if your line is showing 47mb then that's Infinity 2 service when you signed up not Infinity 1 up to 38 meg service .
I am reading this as not mis sold as you where sold the service your line was capable of namely infinity 2 up to 72 meg .0 -
Do you recall using http://www.dslchecker.bt.com/ 4 years ago (not now) and what the results were? I'd say the answer is 'no' to your question.0
