    1) if the claim was paid IN FULL then that would be classed as "settled" and the end of the matter

bear in mind that the 6 month rule has passed for magistrates court and its unlikely that they would win in civil court under the 6 year rule

    2) has to be paid in full, or a settlement offered and accepted by all parties

    3) only if VCS pay the court filing fee AND if they do not discontinue right until the courtroom chamber door with the judge sitting inside

its not a given that it actually goes to court before a judge , not until everyone steps through the inner door (and only after the court filing fee has been paid by VCS as well)

    4) a solicitor would costs more than the court case and few understand these matters

    CAB are generally useless

if you really want the best advice , best free advice , look in post #2 of the NEWBIES FAQ sticky thread near the top of this forum, everything is explained in there, but it is complicated and will make your head spin

people on here will advise you for free as it progresses

if you decide to fight , then the AOS should be done on the MCOL website, but do not enter ANYTHING in the defence box, this doubles the 14 days to 28 days

ps:- frankly , I am amazed that VCS is trying a civil court claim for RHA Doncaster Airport , although I believe there may be a couple of active cases for LJLA Liverpool over on pepipoo forums, so good info may be had from those if they havent gone "off the forum" ie:- behind the scenes
  • Hi,
I've got almost identical case and just recently have been sent Claim form from County Court Business Centre which I need to respond to in some way.

I have appealed in the past to the PCN but as you can imagine it was rejected. The original penalty of £60 has now grown to £237 including all the fees and interest.

I understand I could disagree with the claim and challange it and need to start by doing AoS on MCOL website without giving any details of my defence. The point is if it gets to court I don't even know on what grounds I should defend myself - is it all about the legal bits which I have no knowledge of or I can just explain why I have stopped in the bus lay-by. On top of that I have already tried to explain the reasons in the previous appeals to VCS so in some sort of way I have admitted stopping there. On the other hand their arguments that I have parked (depending on the definition of parking and stopping) and caused issues to traffic safety are really weak in my opinion. It was almost midnight, no traffic around and stopped there literally for 2-3 minutes.

Other option I'm considering is to admit just a part of the claim and proposing to pay original £60 fine just to save myself all the hassle. Is that feasible at all?

I would really appreciate any advice on this subject. I wanted to contact CAB but as most people say they are useless.

    Thanks

No, not at all, and writing to them to try to get that just shows you as a victim Defendant who is scared of court and not on a forum. Do not try.

THEY WILL NOT AGREE AND IT WORKS AGAINST YOU AFTER THAT AS THEY HAVE YOU MARKED AS A VICTIM WHO WILL FALL OVER IF THEY BLOW A PUFF OF WIND AT YOU.

You have no chance to pay £60 but 99% chance to pay nothing (stay with us!).

You need to come off this ancient 2017/18 thread and read the other Doncaster Airport defence case from last month (search the forum).

And then start your own new thread showing us the defence draft based on that other one we've already worked on in recent weeks. Saves you and us so much time.

No link, I never do that. You can use 'search this forum' as quickly as I can...

    NO REPLIES HERE PLEASE.
