    So to summarize:

    1) You had a parking event on the 18th September 2011 (over 6 years ago)
    2) BWL started a claim about this parking event prior to the 6 years being up but subsequently discontinued and you have an official notice of discontinuance related to the claim for this parking event from the court
    3) BWL have restarted proceedings on this same parking event threatening to take you to court over it and have started this all over again over 6 years after the same parking event (that they discontinued on)

    Wow.

    Yep, call the court tomorrow.

    Yep, email the DVLA

    Yep, email the SRA

    From what I understand, the six years is actually six years and a bit to allow for "finishing off/winding up" an existing claim, so the scammers could in theory go over the six years for the claim they started in February.

    However, I don't believe they can start a new claim once the six year date has passed.

    As above, Court, DVLA, SRA, local MP, local and national press should be contacted fifthwith about this disgraceful behaviour.

    What about a counterclaim for the misuse of the court process to harass and frighten people. Can't think of a better time to send in a counterclaim.

  • Rang the courts and they have confirmed that the case has been discontinued. So now I will put in my letters of complaints as suggested. Don't think I want to counterclaim but can I claim defendants costs because I have already done all the work on my defence?

    If your case had already been transferred to the small claims track when it was discontinued then it's highly unlikely you'll be able to claim costs... Plus it would cost you £255 just to set up the costs hearing.
