CPM UK Car Park Managment placed 'Legal Notice' on car

Hi,
I received a legal notice on my car today. Is it just an empty threat? or something else? I am unable to post a link/image.

But the overview is;
"This vehicle has breached the site parking conditions.

Due to these breaches and charges associated with them, a county court claim is now being filed agasint the register keeper.

In order to avoid these claims going ahead please make a prompt payment using one of the following methods...."

I have never received a parking charge notice, nor any have been received in the post. There is also no way to check these 'charge notices' as they have provided no reference number to view these.

The management company of my property have already said they would remove any parking charge CPM would give me, as its their fault that I am yet to receive a permit.

So yeah what is this legal notice about?

Thanks

From your post I've managed to work out that you have parked in an area where CPM would expect cars to have a permit on show.
Your car didn't display a permit so you received that notice.

As your property management company have agreed with you to deal with this, shouldn't you be seeking help from them?

Yeah... that's what it is all about.

Now, you should read the NEWBIES sticky/pinned thread where you will find lots of other useful information.

Please do come back with any further questions that remain unanswered.

You are correct, sorry for not including that.

My old permit is displayed, but they brought a new system in, with a new parking company and I still haven't received the new permit after 6 weeks - I am a tenant at the property.

I have contacted the management company, and will hear back Monday i presume.
I was just wondering what the 'legal notice' was they attached to my car, as these new parking regulations only came into affect on the 8th of September, surely I would of received an NTK first, before this threat of a court claim.

Thank you, I am aware of the newbie post, I used it when dealing with private parking companies previously.

    Thanks again.

why do you need a permit?
    is it your space?
if it is your space then what does your lease/rental say?
odds on you should be telling the parking company to fro and stick their permits where the sun doesnt shine, and the same to the management company.

That needs reporting if it is actually from a PPC it flies against all the rules.

Any chance of a scan of the ‘Legal Notice’?

Host it on a free hosting site like tinypic, imgur, Dropbox or similar, copy the url then paste it into the reply box here, but change http to hxxp so that a regular can then convert the file for viewing (newbies aren’t allowed to post live links until they’ve got a few posts under their belt).

Let’s see what this is all about, so we can help you get rid of it from your life.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

    Thanks for your replies.
    is it your space?
if it is your space then what does your lease/rental say?

Yeah it was the space that is assigned to the property. Lease says:

-To park in the car parking space, garage or driveway allocated to the Property, if applicable.
-Keep space space clean etc and not to park any roadworthy vehicle at the property.

That is all I can find regarding the space. Nothing in my actual lease with the estate agents about displaying a permit.

How can an inanimate object breach conditions?

So a claim is being filed even before the alleged debt is brought to the attention of the person (or is it the car?) who supposedly owes it?

Ah, so they aren't filing the claim after all.

That notice is so misleading it's possibly criminal. See what you're up against?

And anyway, looks like you have a right to park there anyway, as per the lease.
