I think thd OFT are looking in to this matter, and having something done about it, such as an eqivalent to the direct debit guarantee. I also agree it is the RAC's fault, the bank does not have details as ejones says but why allow this slack in the system when it clearly causes so many problems. It really does remove the point of having a new card numbers (if it is changed on replacement for whatever reason) and expiry dates on these cards. James

Well, no, having a CPA would be pointless if you had to notify them every time something changed on your credit/debit card.

But something like the DD guarantee would be an improvement on the present system.
  • If the policy was cancelled and RAC have made the error are they compensating you for taking the money from your account and keeping a hold of it for 14 days?
Not the money but more for the principle of it, i'm sure if the shoe was on the other foot they would have charged you for the mistake

The alternative would cause more mayhem believe me.
I'll give you a quick example - you pay your ISP through a credit card on a CPA. Your card expires and you get a new one - you don't think to do anything about advising ISP about new card - they try to take money - the transaction is refused - result your internet access is blocked. As you have no access you would have to resort to phoning to get re-connected.

The slack in the system is people willingly giving their card numbers to companies without giving a thought of what happens if they want to cancel.

I have a CPA with onetel (talktalk) and they have asked me to 'update' my details when the old ones have 'expired'. So there does not appear to be a standard approach here (c/f direct debits)

I suppose (in law) it always comes down to exactly what the customer has agreed to. If a CPA is to be 'open ended' then that would have to be agreed (and in writing) at the outset?

I think the whole system should be brought in to question about whether or not it is actually needed, most people with debit or credit card also have a bank account they can pay by DD from, especially if the banks are going to allow old and expired cards to be used. I am going to see if I can find out how these transactions are processed if there is a particular code that is applied to them to allow them to use old and expired cards without it being declined, or being flagged as fraud by someone using a lost card, from the perspective of a computer programmer I dont think I would be willing to write such code. To me it defies logic, and as a practice should be ceased. James

They can. My CPA's with eBay and Tiscali can both evidently be on either a debit or credit card.

Enjoy the fun when you realise how bad Tiscali really are and want to leave them then

At least with a direct debit it can be cancelled ;)

Hear, hear!! I left Tiscali a couple of months ago and they still owe me money! Would never, EVER trust them with a CPA.

I agree about Tiscali. They still owe me (well, my dad) about £60 from 4 years ago but I gave up as I was spending so much on calls. They charged us a cancelation fee and some extra for a service they couldn't provide me with. Does anyone know if CPA can be applied on Belgian credit card as that's what my dad paid with for me.

Well you write to the companies that have CPA and see if you can persuade them to take direct debits instead - at the same time ask them who will pay for them to completely overhaul their payment systems to accept d/d, and see how far you get.
Millions and millions of transactions like this are processed every week/month/year and only a few have problems.
I don't think you are going to get very far.

It is down to personal choice - if you don't want to use CPA, ask for a D/D mandate - if they can't/won't take your business elswhere.
