thanks Keith, will i have to read out my whole defence and witness statement or will the judge simply ask questions of it and go from there? this is all becoming very daunting now.

its funny because they have included in their 'evidence'a picture of the 'authorised vehicles only sign' however this is not the same as the sign at the land in question. it's similar but by no means the same.
Assume you have pictures of this difference ?

Ok, I'm home now. court was Dudley county court. I forget the judges name as I was so nervous.
turned up at 925, made myself know to the usherwho told me I was on a small claims list and may not be heard until 11, 12 or 1 etc depending on how it all pans out.
sat waiting till around 1015 and the usher came and said your case will be heard in around 20 minutes with judge....?
still no1 from oposing side has spoken or made themselves known to me. I'm then called in to the court room.
judge was a very nice lady, she opened with saying the claimant hasn't turned up and read out CPR 27.9 staying they had fulfilled requirements and didn't need to turn up.
she the said what would of happen if they had turned up ie them state their claim ask me questions and so on.
as they hadn't turned up she went over a few things regarding the case and got to the main points and my main defence which was that the signage was appalling. she looked at their and my evidence and was satisfied that the car park in question needs better and more signage as it's been used for several years by the local community and suddenly changed over night. basically awarded me the win on inadequate signage to make a contract with the driver.
at times a thought I was going to lose it seemed to see saw back and forth.
please dont shout but I didn't pursue loss of earnings as I was just so glad it's all over and was flustered at the end when she was asking me.
lots of other things ive missed out probably but im still on a high will update further.

oh she first said.... "ive seen the points in your defence many times"....I responded, "sorry ma'am, as I'm not legally trained I have used the internet and online forums to help with my defence as it wasn't cost effective to employ a lawyer for the sake of 273 pounds" she was happy with that response0
