PCM Issued parking ticket at Hayes & Harlington Station

Hi All

I got a letter in the post from PCM issuing a fine for dropping someone off outside Hayes and Harlington station (High Point Village). As I have been made aware by the forums there is a 10 min grace period when dropping people off and will highlight this in the appeal.

I am writing to find out if anyone has been successful with getting PCM off their back (based on the 10 min window) by following the instructions in the newbies thread? And what sort of response they had to that defence?

I have read through previous postings regarding the same company / incident location but can't seem to find what the resolution was.

Any advice or pointers would be greatly appreciated.

    you willl find that parking companies reject the vast majority of appeals no matter what is said , so its unlikey to work (even if it is mentioned)

    as this was a station , POFA2012 does not apply , bylaws apply

    so do not reveal who the owner or driver are, appeal as KEEPER only , expect a rejection and then ignore unless you get court papers

    Please first confirm the name of the parking company as there are several with the same or similar initials who belong to different ATAs, meaning that the appeal templates are different.

    If the car park belongs to the station, then railway byelaws probably apply. If this is the case then you should add that point to the initial appeal template, plus the point that the scammers have failed to allow the grace period(s) stipulated by their ATA, so they should cancel fifthwith.
    Don't hold your breath though.

    Make sure you do not reveal the identity of the driver. Only ever refer to The Driver and The Keeper.

    Hi all

    I've been advised to post into this thread instead of the new one created so here goes:

    I have received a second Gladstone's letter saying 'we now may be instructed to take legal action against you.... reply within 14 days to avoid any further action'. The letter is from Gladstone's as the reference number starts with a 1 (saw this in another thread).

    Refusing to pay as the car wasn't parked - as in the photo a passenger was dropped off by the driver outside the station. There are no signs saying that drivers can't drop off passengers. The photo that was taken was off the passenger getting out the car.

    At the time wedid not reply to their letters because a friend advised not to as he ignored all letters and didn't get a courts summons and I couldn't find any cases on the forums where people have replied saying they have been successful (having the fine removed) in following the advise posted. Still can't seem to find a post on that.

    I've read posts about Gladstone's Letters but the ones I've read go into how the letter isn't from Gladstones etc etc.

    @Redx has suggested to ignore the Gladstones letter. Is this the case? Have there been cases where people have responded to the Gladstone letter and what was the outcome?

    If this can't be solved or is too late - let me know and I'll pay the fine.

    Are you saying you didn't send the initial appeal as you were advised to do, but instead listened to someone who probably is still inside the six years that a PPC can start court?

    You haven't told us if this was a station car park covered by byelaws either, or the name of the PPC.

    You can ignore a letter that asks for payment to a debt collector and if it is not a real LBC it will not be enclosing PAP reply forms, as required in alleged debt claims.

    Later we expect you to get a real LBC, and then a claim, and then we expect you to WIN.

    People who do go on to get a court claim, win 99% of the time here, when fully coached.

    No worries. A roller coaster for you this year to beat it, but it's very, very winnable.

    If/when you get a real claim come back to us. Solicitors have to jump through a huge number of hoops to comply with CPRs, and few of these down market law firms manage to. Google "you've been Gladstoned" + "parking prankster".

    This is an entirely unregulated industry which is scamming the public with inflated claims for minor breaches of contracts for alleged parking offences.

    Parking Eye, Smart and a smaller company have already been named and shamed, as has Gladstones Solicitors, and BW Legal, (these two law firms take hundreds of these cases to court each year). They nearly always lose) and have been reported to the regulatory authority by an M.P.

    The problem has become so rampant that MPs have agreed to enact a Bill to regulate these scammers. Watch the video of the Second Reading in the HofC recently.

    and complain in the most robust terms to your MP. With a fair wind most of these companies may well be put out of business by Christmas.
