myHermes-Parcel Not Delivered to Correct Person. What Are My Rights?

I recently used myHermes for the first time to deliver a Pandora bracelet I sold privately. I paid to insure the bracelet at it's value of £185. The recipient did not receive the parcel but it was signed for by someone within their block of apartments. After contacting myHermes several times they are now sending a lost parcel claim form to me. If they refund the cost of the bracelet I will have to give that back to the customer leaving me £185 out of pocket.

Do I have any rights here? Am I able to pursue criminal proceedings due to the fact myHermes have been negligent in delivering the parcel to the wrong person/address & that it's been stolen? They're not even looking into it despite many emails & live chats. I asked them to investigate with the driver but told it won't be looked into any further. I am absolutely livid

    Why will you be £185 out of pocket? Surely you had the £185 from the buyer before you sent the bracelet?

    How will you be £185 out of pocket? If the customer payed you you still have the £185 and you would refund then the money from myHermes, if they haven’t paid you you get to keep the £185
  • I have to refund the customer £185 for the purchase of the item not received. I paid £185 for the bracelet thus leaving me £185 out of pocket. The item was insured for it's value which is £185.

    Seriously, haven't you worked out the fact you would have two lots of £185? think about it.

    Why? You have already refunded her her money so why would you give her any more?

  • I bought the bracelet for £185.
    I sold the bracelet for £185 which is now missing.
    I have to give the customer the £185 I will (hopefully) get back from Hermes.
    I therefore will be left with no bracelet which has just cost me £185

    NO, you will have received £185 twice, one from the customer once from Hermes. You will have given one of those monies back to the customer, leaving you with the other, which was the intended position all along. ie you are up £185 and the customer has no bracelet but is not out of pocket

    You'll get £185 from the customer and £185 from Hermes, you give your customer £185 and keep the other £185.

    Let’s pretend you have a separate account just for this transaction.
    You have received £185 off the customer for the item so you have been paid.
    You will receive another £185 off myHermes meaning the total so far is £370 in your account
    You then need to refund the the customer there £185, leaving you £185 in your account too spend as you wish
