Smart Parking ordered to shut down illegal car park and pay back "fines"

    It seems Smart are not too keen on the idea of refunding their parking "fines". Shock!

    More shockingly, Smart have refused one punter his money back because "he didn't pay for his time on site". Wow!

    Surprised a local solicitor hasn't seen the £££ signs and tried to get all the victims together for a class action.

    Not surprised that Bradford Council are about as much use as a chocolate teapot in all this.

    Again not really an issue for the council as they were simply the previous lessees of the land before Smart took over. Or perhaps you are referring to the council's trading standards department?

    The BPA's comment is the one that jumps out at me.
    The British Parking Association (BPA) said:“There is no set procedure to obtain a refund. The main course of action would be through the courts however, this could be costly and time consuming.”

    The BPA also urged motorists to write to Smart Parking setting out their case before considering other options.

    Surely the BPA have the power somewhere in their rules to compel Smart to remedy this situation and repay the charges?

    The problem I think is that the MSE regulars here can't easily get to the affected punters to offer help and guidance.

    The BPA has said it probably needs to go to court to sort out, so the only way I see is for the motorists all to issue small claims. Lots of individual ones would bog the whole system down, so class action may be better, but how do we get that message to those needing help.

    Leaving comments online under the newspaper article has never been effective. It might reach a few people, but will also attract the usual Knobs who say, do the crime, pay the fine.

    yes , but the BPA are fast loosing members and cannot afford to antagonize smart

    Might the local paper feature an article (or just a letter to the editor) describing what remedies victims can pursue?

    I'm also surprised that a local law firm to the area hasn't seen an opportunity... :think:

    the members bill does early next year.
    BUT if they follow Murdo Fraser, the Scots MSP with
    his c*ck eyed ideas ..... god knows

    The media just play games with this and never follow
    through, how brave does a reporter have to be to expose
    the scam ????

    The BPA are just a farce and just holding on with the
    skin of their teeth. They know the scam games of Smart
    The trouble is, Steve Clark is too yellow bellied to do
    anything about them.

    The scam goes much deeper than the unethical BPA
    and the crazzies who run the incompetent IPC

    I disagree with that , Steve Clark is an employee and TOLD what he can do or not


    I do believe tho , that if say 6 or more of the "leading" parking companies pull out of the BPA , that there funding will be compramised and they as an ATA may falter and fail

    perhaps they should get some in house solisitors and offer a "one stop shop" , inc court coverage
