Argos do seem to be falling apart. Some months ago I ordered a bed and a mattress from them. The mattress arrived as expected but I have never been able to discover what happened to the order for the bed. From my point of view, it appeared simply that I had to deal with half-a-dozen separate incompetents, each of whom said I would be contacted with information.
In such circumstances the CAB are probably correct that the small claims procedure will be quicker and easier.
Dont worry if you have no evidence - a court may well believe you without any evidence.0 -
On what basis do you think a court would find in favour on a litigant with no evidence. Yes civil actions are based on balance of probability but I've never come across cases settled with no evidence.
Can you provide me with a couple of examples please as I need to sue someone in small claims and although I know I'm in the right the level of evidence I have isn't great.0 -
No unfortunetely there is no reciept, I didnt get any confirmation of the order...so dont understand how the package was sent. finally managed to send the letter off via email today.
I have no proof of order confirmation or reciept nothing- but the texts I got from the delievery company saying they would collect text confirmation.0 -

Stop worrying. In reality you appear to have lots of evidence.
Presumably, if you go to the local library you can find and print your order from the Argos website.
Somebody here can probably tell you how to print the texts from your phone.
And you have your phone bill - if the other side dont like your explanation for the calls they will have to provide an alternative explanation.0 -

You could start with most of those cases where the defendant provides no response. Utilities and local councils apparently manage to win cases as a matter of course.0 -
Hi I emailed and have been refused twice now any help from argos.... they've told me to seek outside independent advice!!! That's when I asked if they were apart of nay adr schemes...I have no receipt no proof! There is something dodgy going on..I looked back at my texts thanks tot he poster who reminded me.
The name of the text is EXERTIS UK MAIL....So why did Yodel come to pick up package, not only that they specifically said its for argos. very confusing.
****if ANYONE WANTS A SUMMARY PLEASE LET ME KNOW ILL POST IT AS I MIGHT GO TO THE OMBUDSMAN SERVICE***. But this is a last resort as without receipt what proof is there other calls and texts. As I never received an order confirmation as it was done by an argos glitch in the system that sent me 6 boxes instead if 1...maybe the **same glitch** that sent yodel instead of Exertis UK mail!0 -
Im starting to think argos made a mistake and sent the wrong courier service...0

There is nothing unusual about one delivery firm using another courier.
You could try to get a tracking number from Exertis which they must have set up when they sent you the text.
You should then be able to find what they think happened to your parcel (and that is not infrequently different to what you get told on the telephone ).0 -
