Carphone Warehouse Cash Back

In short, I was promised £120 automatic cash back when I took out a contract at Carphone Warehouse. This claim was documented in my order summary. I still have the paperwork.

I believe they were supposed to send a cheque to me 28 days into my contract.

I contacted Carphone Warehouse and received the following ambiguous response:

Having a detailed look through your account I can confirm that the contract you are referring to was unsuccessful therefore you aren’t eligible for the £120.00 cashback. I apologise as I know this is not the response you were hoping for.


It is clear in black and white that they have failed to adhere to the offer.

Can anyone advise me what to do?!

    You need them to define what 'unsuccessful' means in the context of the contract you have (ie, was it only for the first 100/1000 contracts, or within a set date range ect).
    Also go through the T&C's you have and see if there's anything in there. . .

    IF you've complied with the t&c - and if you don't know in advance specifically what they are you shouldn't be doing it - it's simple. Send a LBA giving them 7 days to pay up or face immediate legal procedings against them to recover the payment, court fees, incidnetal costs (won't be any in all probability), court fees and statutory interest. If they don't cough up, sue. Don't allow them another 28 days etc - they do like playing those games. HOWEVER - their response suggests it was a full cashback contract (i.e not automatic) in which case you haven't lost it but you need to understand what a normal cashback contract is.

    In either case - NEVER deal with CPW in particular or anyone else generally if you aren't ready and armed to go down that route for the start - which means knowing what to do beforehand.
