[STRIKE]Where did that list come from?[/STRIKE] That above list is specific to Misleading Actions of the trader, the OP's case would be dealt as a Misleading Omission.
The legislation is quite clear:
Apologies, it does relate to misleading information generally (which comes under misleading action rather than omission).
I'm still not convinced its material information that would distort the economic behaviour of the average consumer though. Imo the material information would be the fact its 2nd hand, the mileage, its age but not necessarily who the previous owner was. Especially when who the owner was doesn't give any definitive answer as to how many drivers it had or whether those drivers perhaps had driving habits that would require parts to be replaced earlier. You keep using that word. I do not think it means what you think it means - Inigo Montoya, The Princess Bride0 -

I agree completely with this, my recently bought car had 75k miles on the clock at just two and a half years old. The dealer knew from the V5 that it had been used as fleet car but had no way whatsoever of knowing how many drivers, it could have been one driver going all over the country or 1000 drivers each doing 75 miles. The dealer bought it at auction like most of them do so it’s not so much deliberately withholding information but they have no possible way of knowing.
Every car we’ve ever bought, as well as asking how many owners we ask who was using it. The cars we’ve bought that have had just one or two previous owners as private individuals have caused us more problems than the three that have been fleet cars. The fleet cars may have higher mileage but they are serviced regularly and on regular maintenance schedules. I’d take an ex fleet car over a private car any day, just think it could have been a boy racer using it and trashing the clutch.0 -
I don't agree. Had the OP been aware that the "one previous owner" had in fact been a rental company then that of course would've influenced their decision to buy at the price agreed, as it would do for most reasonable people. I can guarantee with the shoe on the other foot so to speak and you took a car in to part exchange where a previous owner was a fleet or rental company you would get far less than you would do normally.0

Funny, all of the valuation tools/guides and the dealers (anytime I've part-exchanged) ask the mileage, age, what type of car, condition etc but not one of them ask whether it was used as a fleet/rental car.
Indeed on many of the pages detailing what affects a cars value (including colour), not one of them state that it being ex-fleet/ex-rental will affect its value....I wonder why that is?You keep using that word. I do not think it means what you think it means - Inigo Montoya, The Princess Bride0 -

I've been asked before and generally no deal is complete until the V5 has been inspected.
All the v5 tells you is who the registered keeper was. For fleet cars, this can sometimes be the person who's driving it rather than the company.
I've never been asked - even when trading in ex-company cars! You keep using that word. I do not think it means what you think it means - Inigo Montoya, The Princess Bride0 -
dont treat them with much care.
Well they must of treated this one with some care as you parted with 20k for it.
fleet cars etc are more often enough looked after better imo0 -
Has the car got any service history? I know some rental companies never service their cars in the short time they have them.0
