Please help Faulty purchase

We purchased a van from an independent dealer. Called up about details said it was just under going mot and had an oil leak which they where fixing and to call in a few days when ready for sale so we did and my husband viewed the vehicle was happy with it overall asked if oil leak had been fixed the salesman said yes it had. Purchased the vehicle paid £200 on cc for security. Any way once the insurance was swapped over my husband started the van the glow plug lights do not work a light was out and it still has an oil leak. We called the dealer said he would call back he didn't,called again explained what the problems were the guy on the phone said boss was out of office text me a number and will call you again no response. We decided at this point we had lost faith in the dealer and wanted to return the van within the 30 days under the consumer rights act. My husband went in person with a letter explaining the issues and our right to reject the vehicle. The person there (who sold us the van) said boss was in france and didn't know when he would be back husband gave him letter and asked him to sign our copy as proof that he had received it. He refused told my husband he wasn't signing anything and to f*** off and to leave the premises husband said he felt threatened by his behaviour. So I will be sending letter recorded delivery so I have proof they have received it. I have a log on my mobile of the calls and the text sent. I have photos of the oil leaking from the van. What do I do now any advice and also has any one had a similar experience. TIA

^ This is an important question.

If it's a business purchase - even for business use by a sole trader - then the Consumer Rights Act does not apply.

It was purchased with a possible intention to be used when my husband sets up as a business but this has not happened as of yet and not sure if it ever will at the moment it is being used for his commute to work and private use only. This was a private purchase.

As above, contact you CC company and issue a Section 75 claim. Do not mention the possibility that it's for business use as your options to reject will soon disappear.

Thank you I am looking into section 75. The van was a private purchase. We do not have a business and as I said. myself and husband are both in full time employment. Things have picked up back in his work so we wont be starting business up and he will be going back to a car he is using mine at the moment the van is sat on the drive.

expect lots of questions from your CC company. People don't normally a commercial vehicle for anything other than commercial use.

The vans was purchased for a business venture. You say you have not started teh business yet but you have purchased a van towards it.

    Is that not a start?

    A photo of oil leaking?

    Agreed.

OP, can you honestly say you purchased the van as a consumer as defined by the CRA?
“Consumer” means an individual acting for purposes that are wholly or mainly outside that individual’s trade, business, craft or profession.
