Hopson Solicitors Letter

Hi All, first time posting so please be gentle! I received a parking ticket earlier this year (approx six months ago). Foolishly, I never acknowledged any of the letters that i received previously following bad advice from a friend. I’ve thoroughly read all the pinned/sticky threads but can’t work out what to do next :-(

I have recently received the below letter, could anybody please advise the best course of action? It would be greatly appreciated!

“Dear Sir,

Our Client : CPS Midlands
Vehicle Registration XXX XXX
Total amount outstanding £160

We have been instructed in relation to the above debt which relates to Parking Charge Notice, which have already been sent to you by our client’s agent, TNC Management Ltd.

You are legally liable for these charges and it is out client’s right to recover this debt.

In 2015 The Supreme Court confirmed that charges based on contract were recoverable in civil law. Prior to the case of Beavis V Parking Eye there was a general misunderstanding that parking charges were not recoverable debts. This has now proved to be incorrect.

In view of this we require that the above debt is paid within the next 14 days.

If it is not paid within that time we will advise our client that legal proceedings should commence against you. Such claim will result in an increase in the amount being claimed as interest, court fees and costs will be added.

To avoid the risk of these extra costs you need to pay the debt now. You should also be aware of the fact that a court judgement against you will remain on the public record for up to six years. This can have a serious effect on your ability to obtain credit.

To avoid action you must now contact our client’s agent and make immediate payment. The authorised agent is TNC Management Ltd. Phone them on 01242 214645 make payment online at **TNC COLLECTIONS DOT COM** and select PAY NOW

Please do not contact us as we are unable to advise you. All contact and payment should now be directly with TNC Management Ltd.

    Charges based on contract have always been recoverable in civil law. The Beavis case was about whether or not those charges could be struck down as penalties.

    The Supreme Court ruling was that although the penalties rule was engaged, the charges could be allowed to stand if they served a legitimate interest.

    It does not make all private parking charges recoverable, only those where the facts and circumstances are the same, or substantially the same, as those in Beavis.

    I have been providing assistance, including Lay Representation at Court hearings (current score: won 57, lost 14), to defendants in parking cases for over 5 years. I have an LLB (Hons) degree, and have a Graduate Diploma in Civil Litigation from CILEx.     That letter is also telling you to pay a debt collector which you can ignore, unless they send you a letter before action.

    This is a debt collector letter {text removed by MSE Investigator}. It can be ignored. Please read NEWBIES FAQ sticky, post #4 about dealing with debt collectors.

    Hopsons seem to be new on this scene - so why not bring them up with a bit of a jerk by sending them the letter 'johnersh' drafted for use with Wright Hassall, a solicitor acting similarly. 'johnersh' is a lawyer.

    It will need adapting to reflect what Hopsons have said to you in their letter, but it will cause them to have to answer it and they will then invoice TNC for dealing with it!

    Fight back time.

    You can tell they don't understand by reference to Beavis

    Whilst this a debt collector letter and timewasting at that,
    I doubt that Hopson really understands that this thread is
    just the start on google about Hopson and it now depends
    how much they enjoy a core business that could so easily
    be ruined by getting involved with parking {text removed by MSE Forum Team}

    That letter is full of misinformation and half truths. Jonersh's letter is the way to go, but copy the correspondence to the Law Society and the SRA.

    Make Hopsons aware that you have done so, they may be unaware of the industry scam. Their website

    makes mention of the new CPR rules which come onto force next week so there would be no excuse if they ignored them

    This is a definite candidate for Johnersh letter (slightly modified) copied to the address on the letter, the SRA and the home address in Cheltenham for Hopsons Solicitors (if that is not the address on the letter). A quick google search will derive this address.
