Tenants late with rent, again.

Sorry, so there is only 2 weeks rent owing!
Now that's different. It sounds like your tenant's may well not be as "daft" as you think. I could be that they know Housing Law better then you think!
You better issue normal notice to expire no earlier then the expiry of the term of the tenancy agreement. If your grounds are because 8 weeks or more rent is owing - they can always pay this a few days before the court hearing - and you are then back to square one.0 -
Oh Dear! ........ So you don't know if they have signed the new tenancy agreement that you sent them or not?
This one is starting to look a little "messy" now!0 -

I don't know how your ex knows this stuff but whoever is communicating this info to him needs to stop. This sort of thinkg is going to provoke even more unreasonable behaviour, no doubt and I would be concerned over the state that the property eventually gets left in
Ex needs to stop and really, I think you need to sell up otherwise he's going to interfere in this forevermore. I moved out of a property because the LLs were still treating it like I was living in their home.Everything that is supposed to be in heaven is already here on earth.

There is nothing I can really do to stop ex, he asks our son whats going on and it's hard to let a 5 year old know what he can and can't tell Daddy. I'll just have to try and make sure he doesn't hear me and Mum talking about this. The little so and so often appears to be totally uninterested in our conversations but can later repeat them word for word!
I am going to state in todays letter that as they have not returned the tenancy agreement this is now becoming a periodic tenancy.
I can't issue a notice to expire no earlier than the end of the tenancy agreement if it's a periodic tenancy as there is no end written.
As for them leaving the property in a mess, it would be deliberate damage if they did, I have visited the property a couple of times since they moved in there and she keeps it absolutely spotless, much cleaner than I ever did! They were also keen to point out to me some possible damage (some tiles lifting in the bathroom) as soon as it started to happen as they wanted to protect their deposit. The best things in life are NOT free - but they sure are cheaper with MSE!:j0 -
do they have to return it, or is them signing it enough?0

If you want to try to get the tenants out more quickly than the 2 month's notice required under a Section 21, you could try the Section 8 route. There are 2 grounds relating to some rent being owed and the tenants regularly delaying rent that is lawfully due and the tenants can then be evicted with 2 weeks notice, but even if proven the judge does not have to award possession back to the landlord, so you are more certain of a positive result with a Section 21. Taking legal advice may well be worth the expense.0

To OP have you done an inspection since the tenants moved in?
Your well within your rights to inspect a property and this is normal at the end of a tenancy whether you want them to stay or go.
I would put a letter through door saying that you need to inspect the property (you have to give 48 hours notice). Put the day and time on that you will be arriving to do inspection and a contact number if this is not convinent (sp?) for them to contact you. If they don't reply turn up with witness and knock if they don't open door write again saying access could not be gained, you will come back in 48 hours and unless they contact you otherwise you will let yourself in and carry out the inspection.
If your gas safety cert is due this is a good time to book a time the gas man can be let in - you need that doing regardless of if they are paying.
This should give you the chance to meet and speak to them. If they avoid you and let you come in without them there, then you will have to hope something is a miss to your inventory so you have a need to discuss the putting right of the problem.
Good Luck0 -
I have inspected the property, when they called to say there was a problem in the bathroom and it was spotless. The gas man is due next month so I will see if I can be there for his visit but it's unlikey as I can't take time off work. I'm not sure I want a face to face discussion in the house with them, he is an odd character - looks like a total thug. I don't think I would feel safe alone in a confrontational situation and I don't have any male friends who I could take with me.The best things in life are NOT free - but they sure are cheaper with MSE!:j0

Your back tracking from getting things sorted, taking a day unpaid off work sounds like a small price to pay for getting your rent or getting your house back.
Also if gas man is there then he is your witness and if you have a polite discussion with tenant (he looks aren't going to change) and he gets nasty or rude then you and gas man leave.
Not sure if you may have another avenue to get them to leave if you can't get a gas safety done due to them - maybe other posters can advise?0
