Well, they've already initiated a refund of the base amount. It's the VAT they are unwilling to pay.0

Sorry it was aimed at you. I was hoping that since the merchant has already initiated a refund of the base amount I should raise a case to say that VAT should also be included in the refund.
Perhaps the fact that merchant has agreed to a refund should work in my favourtheonlywayisup wrote: »I am not sure who that is directed at but it's unrelated to a Paypal claim. See my post above.0 -
Notes for future reference - According to their T&Cs (Section 23 titled "Governing Law")The User expressly agrees that exclusive jurisdiction for any claim or dispute with YuppTV or relating in any way to the use of the Services shall be of the courts of Georgia, United States of America.
And according to this linkThere's no right to cancel contracts or purchase agreements. Whether you can receive a refund is dependent on the retailer's return and refund policies.
So all in all my hope hinges on the fact that their T&Cs do not explicitly say that VAT is non-refundable.0 -
The USA does not have VAT, they have State taxes which are applicable to goods purchased in the relevant state they trade from.
If they charged UK VAT this would indicate a UK trading office which is VAT registered, doubtful so it's perhaps a state tax they are refusing to refund.
Your invoice should have the VAT number on it if they charged you UK VAT, google the VAT number if there is one and it will tell you who and where in the UK it's registered too.0 -
No, it does not indicate a trading office in the UK.
It is an EU requirement that they charge VAT.

Unfortunately Paypal won't rule a claim on what has been refunded or not, it's about INR or SNAD, as per my post above.0 -
Right, an update. They've come back and said that they are refunding back the VAT. :TNotes for future reference - According to their T&Cs (Section 23 titled "Governing Law")
