Paid Ticket but still got parking charge notice

Can anyone advise on what my next step should be.
I parked my car in a private car park in Brighton and bought a pay and display ticket for £5 which I placed on my dashboard in the correct manner. What I didn't know is that when I shut my car door, the air pressure change must have flipped the ticket over and it was face down.
When I returned to my car, within the time I had paid for, I found a plastic bag stuck on the drivers window of my car stating that a parking charge notice would be sent to the registered keeper of the car. There was no indication on the bag that it had actually been issued to my car or what possible offence may have been committed.
I initially thought that someone was playing a trick on me and tried unsuccessfully to call the parking firm. I recovered my ticket from the dashboard and put it in my wallet (just in case) I later managed to get through to the parking company who confirmed that my car had been parked with the ticket face down and thus I would receive a ticket but not to worry as I could then appeal the process.
I consequently received a parking charge notice through the post and entered into the appeals process advising them that I had indeed paid and displayed as required but unfortunately the ticket must have been turned over.
I sent them a scanned copy of my ticket and presumed that would be the end of the matter. They duly rejected my appeal and thus I appealed to POPLA who are the independent body and was able to point out that, in the evidence provided by the parking company they had provided a photo of the face down ticket in my car on the dashboard . This photo showed the serial number on the back of the ticket which matches the one on the front of the ticket and thus I was able to prove that a ticket had been bought and was valid at the time and was visible although face down. I had acted in good faith and I was confident that my appeal would be upheld.
How wrong I was. My appeal to POPLA has been rejected! There was no mention of the fact that I had bought a ticket and not gone over the allotted time but they seem to be saying that the notices around the car park state that the ticket must be displayed correctly and thus, the ticket was issued correctly and I should pay the charge.
I feel extremely angry that I am now expected to pay £100 because my ticket was not able to be read, even though I acted in good faith and that I have demonstrated that I purchased the ticket as required.
Is there anything I can do??
I am considering letting them take me to court but am worried that I may end up paying up to £410 in court costs plus the £100 charge should it turn out that this unfair ticket has to be paid.

if you separate the above into readable paragraphs so people can actually read it then you will get more people willing to help
and please read the advice in the NEWBIES sticky thread too
and if popla turned down your appeal, there is NO NEXT STEP , not until a judge sees it
thank you
ps , which idiot PPC is it ?0 -
Oh dear oh dear! Why didn't you come here first you have gone about this completely wrong, read the newbies start here thread to see how you should have dealt with this scam industry!
You have thrown away your golden opportunity to nip this in the bud, now you are entering phase three the scary (not really) debt collector scrap paper trail.
Mistake number one never admit to being the driver, mistake number two never ever phone scammers, mistake number three never use mitigation at POPLA stage, mistake number four never believe PPC's or debt collectors.
The £410 + £100 is a lie to panic you into paying, and many PPC's don't go to court anyway.
You need to tell the regulars who will assist you who the PPC muppets are though.0 -
The old fluttering ticket - I had one of those with Brighton Council.
I now keep a clothes peg in the car to add weight to the ticket.0 -
it's all very well saying that I got it wrong by going through the process that was outlined in the charge notice but at the time of receipt of the notice, I was expecting my appeal to be a slam dunk as I had done nothing wrong other than fail to look back after closing the car door. Retrospective wisdom is always easier!
I did read the newbies thread (well part of it) and couldn't see anything that really covered my problem and thus posted in hope.
I have now learned the lesson of "fluttering tickets" and keep Blu Tac in the car

you missed this statement thenWhat will happen if I lose at POPLA or IAS?
Nothing.
It is not a reason to pay, even though the decision will tell you to! Discussed here and in other threads you can find by searching this forum for 'lost IAS' or similar keywords:

What happens would be:
- you will most likely (unless it's a very litigious PPC) just get a series of hysterical 'pay up or else' debt collector letters, or maybe letters from the PPC themselves - see separate post about ignoring them, below. No need to panic.
and post #4 of the NEWBIES sticky thread covers your current predicament
come back if you receive an LBC or an MCOL in the post, within the next 6 years
they are in control not you, so there is no NEXT STEP, so stop looking
and you have still not edited post #1 despite being asked to do so
the return key will help you change post #1 into paragraphs , not difficult and standard practice0 -
The newbies thread covers all situations yours is no different, PPC's rarely uphold appeals they are greedy scumbags only after cash, POPLA is quite winnable but not on mitigation or what happened on the day, but they don't tell you that we do.
But you are in luck you are dealing with a fairly harmless bunch of dunces that can be ignored, along with their useless debt collectors.

But come back in the unlikely event you get real court papers.0 -
Thanks for your post RedX I will have a proper look.
However, I don't need you to instruct me on how to construct sentences. This is an internet forum, not a legal notice or a masterpiece of literature. How I choose to write my posts is only my concern. If you don't like it........0 -
Thing is you come here wanting help.
The advice to alter your wall of text is for your benefit.
Many helpers here won't battle through your wall, so you will get more help if you did change it
But your decision in the end.0 -
