NewGenerationParkingManagement postal PCN

Hello. On the 16.05.2017 I have received 2 PCN's by post from New Generation Parking Management, for parking on private land on 2 separate occasions( 11.05.2017 and 15.05.2017). There was nothing placed on the vehicle at the time. The pictures of the vehicle sent with the PCN seemed to have been taken by an agent on foot. I am the registered keeper and the I did not respond to them, but made a payment of £19 to Private Parking Appeals instead, 2 days later, hoping they will deal with it on my behalf. On the 08.06.2017 I received a Final Reminder from NGPM, telling me that the charge had risen to £100, from £60, both bearing the same issued date, despite the tickets concerned being 4 days apart. On the 09.08.2017 I received a letter from Northampton County Court, informing me that Gladstone solicitors were acting on behalf of NGPM. I have sent the acknowledgement form back to the court, to earn the 28 days to submit a defence to the court. However, I believe I am outside of that period and no longer qualify.
After receiving the final reminder and ever since, I also tried contacting PPA, in order to find out what is happening to my case, but despite several emails and telephone calls(only an answering machine informing me that they are too busy to take any calls) I have not had any reply from them. The only communication I have received from PPA after paying was an email containing an appeal inquiry confirmation and an ID number(ORDER ID #UO0IJ29U ORDER DATE 18 May 2017 CUSTOMER XXXX XXXX Appeal Now - via Parking Cowboys 1 × £19.00 Total £19.00 This order was processed in GBP). I was never told who my case handler was supposed to be, despite them promising that would happen. PPA has been disconcertingly quiet. Not the best customer service. Not even a greeting or reassurance that things are being dealt with. Total silence.
I don't know what to do next and fortunately I have come across MSE today, while looking for ways to deal with PPA and recover the money I paid to them without receiving any help in return. Any advice would be appreciated. Thanks, Michael

This forum can't help over a dispute with PPA.
If you want help over your PCNs then read up about this in the newbies faq thread where you will find advice right through from an initial appeal to defending yourself in court0 -
as above ......
you may wish to read the newbies thread that explains the well trodden path that we suggest ... and gives details of how to defend a court case ...

Stick some paragraphs in there @OP. Many regulars, including me, who might be able to help you, won't bother reading such a wall of text.
Don't disadvantage yourself. Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

If the date on the court claim was 09.08.17 you had 33 days to send in a defence. Call the court today to see if Gladstones have applied for a default judgment. If not, put in a defence today to stop the default CCJ process. This is a system account and does not represent a real person. To contact the Forum Team email forumteam@moneysavingexpert.com0 -
Hello Iamemanresu and thank you for your kind reply. It's good to see some people actually reach out to help the others who don't know how these things work :T. Blessings to you, friend in need :-). I have phoned the court and they informed me that Gladstone has filed for a default payment on the 14.09.2017. I was told that my only option would now be to ask the judge to set aside the decision and if that was to happen I can file a defence. In your opinion, is it worth doing that, or just a waste of time? How likely is the judge to set aside a judgement?0

You have choices - pay up within a month of the judgement date to prevent this staying on the register: if you aren't bothered about the register then arrange a payment plan if you want to spread the cost: apply for a set aside (though what grounds do you have - you knew about the claim, so would need other grounds - google set aside to see when you can use it)
Set aside applications are £2550 -
Thanks Quentin. I have had a look at 'set aside' and you are correct, I have no grounds for that. And yes, those N244 cost exactly £255, not cheap. I am not bothered about the register, I never borough anything and try to live within my means, so credit scoring does not concern me much. If they chase me, I will try arranging a payment plan in this case, although I may not be able to pay them much every month, at the moment.0

Bear in mind they are allowed to enforce a ccj (all at your cost) - meaning they can send bailiffs/get an attachmengt of earnings etc
So if you don't intend any appeal or set aside it may be advisable to contact them with your proposal for paying on the drip0 -
although I may not be able to pay them much every month, at the moment.
You can apply to the court for a variation / redetermination so you can pay in small amounts - usually about £10 / week - but it depends on your circumstances.
https://www.nationaldebtline.org/EW/factsheets/Pages/varyingpaymentsonaccj/instalmentsonaccj.aspxOnce you have been served with an order to pay the CCJ, you only have 14 days to ask for a redetermination. You can usually ask for a redetermination by sending a letter to the court, although you can sometimes be asked to complete form N244 instead. Check with the court. The case will normally be transferred to your local County Court hearing centre if there is going be a hearing. There is no fee to pay.
So if you want to go that route, you have to act quickly. This is a system account and does not represent a real person. To contact the Forum Team email forumteam@moneysavingexpert.com0
