Hello. I am posting for urgent advice please. This is on behalf of my bezzie.
The scenario is; he bought a Fiat car from Arnold Clark, the salesperson told him that as he had been working at Somerfield (the supermarket) for only 3 months he should take the PPI so he could get accepted for the credit as the finance company would be guaranteed their payments.
I told him to make a complaint to Arnold Clark in 2012 and they said he was not mis-sold PPI. It went to the FOS and they agreed with the dealer. - it was a non advised sale. {text removed by MSE Forum Team} My bezzie told me what the salesperson said and I accept his side of the story. He is as honest as the day is long.
I contacted Arnold Clark and asked when they would be looking again at the complaint under the consumer credit act/Plevin.
They have replied saying they are disappointed I have resubmitted a complaint. That I did not borrow money from Arnold Clark. That the finance provider was Nissan Finance GB and they were not paid any commission by Arnold Clark or vice versa.
So I am a bit stuck now. I feel that somebody got a commission for selling the skanky PPI as they were not selling it out of concern for my bezzie's job prospects at the supermarket.
Do you know how I can proceed with this. I want a refund and I want it NOW.

Your friend has already had the opportunity to claim this and has chosen not to.

Hello. Many thanks for reply. My friend made a complaint and was rejected from receiving a refund. Then when Plevin changed things, I asked the Arnold Clark to look again at the circumstances, they have again rejected it, saying they are not a lender and they never paid any commission to Nissan. LIARS. Somebody was paid a commission. This is why I am asking the community here. Many thanks again for any help you can give me.0

I'd be a bit careful about making accusations on a public forum, especially as you don't know the full story (you weren't there when the sale was made, were you, and it wasn't even you who took out the PPI?).0

Hello Vectis. I do know the full story. I wasn't there when the sale was made but my mate doesn't tell lies. If I was in any doubt, I would not continue with this.0

Plevin does not mean the complaint gets looked at again.
Arnold Clark are not a lender. So, they are not liars.Somebody was paid a commission.

Actually Plevin meant a separate complaint against Clydesdale Bank for mortgage PPI was looked at again and paid. £2500 in total. The Clydesdale done this themselves out the blue. Plevin was mentioned in the letter. This is why I then contacted Arnold Clark.0

Plevin had nothing to do with that.
Clydesdale were ordered to go back over old rejected complaints and are in the process of doing that. Those that try again or contact them about plevin see their case brought to the front of queue for that review. Those that do not contact them are in the queue and will get theirs looked at in due course.

No sorry. I have the letter. You don't. This complaint was rejected by the bank, it went to the FOS who also rejected it. This was in 2012. Last week they wrote saying the complaint was being paid as they looked again using the consumer credit act/plevin. Therefore I contacted Arnold Clark asking them about timescales for previously rejected complaints being looked at again and quoted what the Clydesdale had said about re-visiting the complaint. (Plevin)0
