Can I have a full refund

I purchased a new kitchen last wednesday from Howsden's joinery but now want to cancel the order. Initially when I went to view the design they had made I was not going to buy straight away but the sales consultant gave me such a good price & told me the offer would not be available for long that I ended up buying it & paying in full. However the more I have thought about it the less I am happy with my purchase & am annoyed with myself for falling for the sales pitch. Can I cancel the order & get a full refund

    I don't think Howdens sell to consumers, do they?

    If you are a business, then you need to refer to the terms of business that have agreed.

    If you are a consumer, then you probably purchased through a Howdens trade customer. If that is so, then any consumer rights you may have will be with that trade customer.

    Even if you purchased direct from Howdens as a consumer, you are entirely reliant on any returns policy the seller may have.

    Did you make your purchase in store?
    Things will be different if you bought from Howdens as a consumer in your own home.

    What does the contract of sale say regarding cancellation? You are well within your rights to cancel however it would be classed as a breach of contract (unless the contract gives a grace period) and they can charge you for provable mitigated losses.

    i.e if they have started working on a section of it that will only fit in your kitchen and cannot be resold.

    I'm very surprised at this. My sister is buying her new kitchen from Howden's but the order actually has to be placed by the fitter, they simply won't sell to the public, perhaps because they don't want the additional hassle of dealing with consumers. I'd suspect it's been put through as a trade sale anyway. Whether you can insist on exercising consumer rights I don't know but I'd imagine if you do then the person who made the sale is going to be in trouble with their bosses.

    I know it's a duplicate thread but as this post is not on the other one I thought I should point it out just in case the OP takes hope from this one that it is wrong.

    The kitchen is paid in full so no, there is really not much hope of getting anything back now. As far as Howdens are concerned the contract is complete and only a failure to deliver or make available for collection would be grounds for breach of contract, but that is very unlikely indeed.


    I still don't believe it's not been put through a business account knowing Howdens as I do because the staff can't circumvent this as far as I know. But OP if you are a very good friend of the receptionist maybe there is some scope to get a refund using this friendship and a bit of inside jigery pokery, it's your only hope.

    Howdens will sell to the public just depends on the store manager, a sale last Wednesday could have been the one to get that months target so the store gets a bonus. October always used to be the month to buy from Howdens as it's the only month they have a sale on

    Irrespective of what their website may say, some branches are more than happy to sell to the general public.
    I went to Howdens in Redhill less than a couple of weeks ago and purchased a couple of kitchen units and was never asked if I was a trade customer. (I wasn't)

    They have 650 stores selling kitchen's more than anyone else if you go in to buy they will sell you one even if you don't no a staff member. They like to sell to a fitter so its fitted how it should be so people don't come back to them complaining.
