    That's probably wise. I think you are posting information in a way that doesn't always make sense because you are flustered and panicking a bit so it's not coming out right.
    Getting it all on paper, including the background information will probably help you to be a lot clearer at the interview. I wouldn't ring the DWP tomorrow as others have suggested because you might tie yourself up in knots trying to explain it on the phone. Wait till the interview, with support from the solicitor if that's the route you decide to take. Does the solicitor have experience with the DWP?

    An interview has already taken place with the compliance officer, at least this is what i understood to read. When OP stated that there was no mention of the £40,000. If this is the case then i really wouldn't wait to ring them, id do this tomorrow.

    i thought that too, but re reading, I don't think the interview has taken place. OP also be aware unless the DWP have reason to disregard the £40k, which I don't think they will, then your daughter will lose any income related ESA, you will have to prepare her for that.
  • Compliance deal with ALL downgraded fraud cases fact. There has been a data match that has flagged this up. They may consider that she spent all the £28k to get benefit but if you have all the receipts and details then an SDM will decide this as quoted by yourself

    She had a further £40,000 in a bond. When she applied for esa and pip on the phone they asked about any money she had, she said she had none as she did not know about it. I was there so luckily I took phone and explained about the bonds. The advisor told me it was ok as they would not affect her benefits. (Hopefully they still have a recording of this). Now 2 years later they are investigating her

    they do keep recording and can get them. Go to the Interview with your daughter and be totally honest. You will be ok as said write everything down and see the solicitor or cab. Your daughter will not go to prison
  • I am panicking and flustered. I'm not too sure of dates but know it all happened in the last 3 years or so. So need to get statements to get those dates down. Daughter had interview on Thurs with compliance officer and told to hand in bank statements for last 3 years . Got interview with lawyer on Tues. I'm ok with her paying everything back and losing esa. As long as it's all going to be ok and we are square with the dwp.

    When I was on jsa a few years ago I had a Scottish bond. I was told I did not need to declare that. I paid 25 pounds a month over a ten year period and got a lump sum at the end.

    I was told that it was the isa I needed to declare to them
  • you will be ok, have they stopped her benefit they usually email the section to suspend payments if over 16k, if they haven't or they don't then the bond must be ok and they are considering the money spent prior to the claim. Don't panic get the bank statements for them. The OP can be paid out of the DLA or all together. Your daughters illness and the death of your parents must have been hard. I would say you should apply to be her appointee,

    As your daughter has already had an interview with the compliance officer and didn't mention the £40,000, i would ring them tomorrow and tell them. If i was in your situation i wouldn't wait till i've seem my lawyer.
  • She received a letter yesterday saying they were increasing her esa! Go figure . Guess that sent prior to interview.
