Hello all,
Thank you so much for all your help. I sent the defence to the courts and have received a response from Galdstones stating they intend to proceed with the claim. They are requesting a special direction that the case be dealt with on papers alone without the need for an oral hearing.
Please can i have some ore help here as not sure what to do?
Thank you once again for your time0 -
The answer to your question is linked to from the NEWBIES thread. Here's a summary from bargepole of what happens when, what you MUST do in time, re the paperwork & deadlines:

Have you not read this:Note: Gladstones are currently including a 'request for special directions' asking the Court to hear the case on the papers only, without an oral hearing. You should oppose this, and include the following text in D1: “The Defendant opposes the Claimant’s request for special directions, and requests that the case be listed for an oral hearing at the defendant’s home court, pursuant to CPR 26.2A(3)”.0 -
Thank you Keith, that is most helpful. I have an N180 form pre filled in by Gladstones attached to their letter. Should I amend this one and send back to the courts or wait for a blank N180 from the courts?0
-
From that very same post, same paragraph:After sending off your Defence, the Northampton Business centre will send a copy to the Claimant, and then send a Directions Questionnaire (form N180) to both Claimant and Defendant.
Can I respectfully suggest you read the rest of that post in it's entirety?0 -
Thank you Keith and I do apologise. My confusion lies in that Gladstones have sent the N180 so I will wait until I receive an N180 from the court and ignore up until that point.0

I thought Gladstones had sent you a draft N159...
This letter you have, is in fact covered in EVERY Gladstones thread, you would learn so much more by searching & reading some exactly like yours where people have already dealt with this stage, and won.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Hello all, I hope you still have access to this thread as I am after your help once again.
I send the defence to the courts and Gladstones in October 2017 as previously discussed and didn't hear anymore from the court or Gladstones until April 2018. Gladsatones are pursuing the claim and a court date is set for 4th July 2018. They are not sending anyone to attend as requested but have send a witness statement to the court instead.
Are you able to help further or should I give up and pay?
Thank you so much in advance.0 -
When did you send your own Witness Statement and evidence to the court and the Claimant, this month? Please tell us you did...please tell us you didn't just do a defence and think it would go away?
This is all set out in the NEWBIES thread.
You knew a hearing would come and you should have done the WS and evidence. The letter that gave you the court date told you that, as well.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

The defence was sent to Gladstones and the court in October 2017, I was unaware I should have followed this up with a witness statement. So, I do have to tell you that was all that was sent. I believed Glastones would drop the case once they were asked for a witness to attend the hearing.
I do find this all very confusing, I guess it's ok for people that have an understanding of all this but for people like me that knows absolutely nothing it would be far less stressful to pay the requested fine in the first instance rather than try and fight. This is what Gladstones and UKPC thrive on but all the legal jargon is beyond my understanding I'm afraid.
Maybe paying is the simple option as I feel defeated.
Thank you for trying to help me in the first place.0
