It's not good news I'm afraid ladies and gents.
I managed to avoid judge Collins thankfully! I ended up with judge Scannel. Who I have to be honest was a lovely lady. She was very approachable and made the whole thing very relaxed. I don't have a bad word to say about her.
At first the judge said "now to begin there are points raised in the defence not dealt with by the claimant and I have not received your full bundle" and I thought this is a good start! However the judge agreed to look at spares the claimant had with her.
What it all boiled down to was Millenium providing the LR map for that small patch of land. I did mention as I feel it shouldn't be allowed to happen, that the only reason they had that was because they didn't even start their work on the case until after the court deadline. I didn't expect this to make any difference but wanted to make a point.
The judge accepted I was not the driver but found me liable as RK.
She said she thought the signage at the location is adequate and forms a clear contract. I do not agree with this myself. It's just a square of concrete with 2 A5 size signs on the wall. No barrier or fence. If you didn't know the area and parked there in the dark you'd never know. And what normal person starts searching around in the dark with a torch or their phone, looking at all the plethora of signs afixed to the side of a building 10 feet away? But anyway. That was her finding.
She did make it clear that she's sick of telling Millennium to stop adding costs on which she will not allow. So it was the £100 from the original ntk plus hearing and legal fees. £200 all in. So could of been worse, could of been better.
I did feel that she gave the case a good going through and that she was on my side. Although I don't agree with her finding that the signage etc is adequate, the rest she was spot on.
In her summing up she said "you really had done a fantastic job of your defence and I thought you were going to win until the late submission of LR maps from the claimant. It gives me no pleasure in finding against you and I am sorry all the effort you have put in has been in vein but you certainly have done yourself proud"
The millennium rep was a Barbara Williams. And she was also a nice lady to speak as I find.
So that's it. As my first proper brush with court I have to say I'm very disappointed that the rules seem to be negotiable in a lot of ways. Deadlines are not really deadlines. I didn't think that sort of thing would be allowed. But such is life.
Thank you to everyone for your advice. It's been very helpful and clearly the defence I mounted with advice from this forum was enough to impress both the judge and the claimant, all credit to you on that.0

sorry to read that vb, take heartv tho that millenium have not won any money on this case gladrags will have invoiced them , the cost of the solisitor as well deduct the court fees (£50) leaves £150 , less than milleniums outlay
at least one judge has marked there cards regarding stupid costs , however those stupid costs are always accepted with default CCJsSave a Rachael

Yes, disappointing that she allowed them to submit evidence at the hearing and effectively ambush you. It should have been disallowed. I thought your LR info showed the landowner didn’t own the car parking area?Although a practising Solicitor, my posts here are NOT legal advice, but are personal opinion based on limited facts provided anonymously by forum users.
