DVLA Fine

Hi I have a question on behalf of my partner, she has received a fine from the DVLA for not sending off the log book after the sale of her vehicle, she had sent it off it was lost in the post or whatever and DVLA said they never received it, before she sent it off she took a photo of it with the new keepers name and date etc on and then send the logbook to the DVLA. Now the DVLA are saying that she is still liable for the fine even though she had proof that it had been sold and she is being held responsible for the letter being lost in the post is there any way to dispute this higher up? Many thanks

Are you sure the fine is for "not sending off the log book after the sale of her vehicle" and not for being the registered keeper of an untaxed and not SORN'd vehicle?

Pay the fine or go to court, once your trapped in the DVLAs automated enforcement system (and it is) those are basically your only choices.

How long is it since she sent the keeper change off? The V5C states clearly that if confirmation of receipt has not been received in four weeks, it should be chased up.

I would google DVLA lost my.... I have and there are loads of sites which show you how to defend it. Can not say if it will work but according to Google this happens all the time.

    You can complian at https://www.gov.uk/government/organisations/driver-and-vehicle-licensing-agency/about/complaints-procedure.

Again not sure if it helps but BBC estimate 500,000 letters lost each year so letters for DVLA some must go missing.

    TBH I would complain.

Can you explain which piece of statute law, whether primary legislation or statutory instrument, gives any legal force to that statement on the V5C?

    None. Did I say otherwise?

I was suggesting no more than it was a wise precaution to follow, to avoid precisely this kind of problem.

Good advice to follow up. Better than ignoring and getting a fine.
