Who pays inheritance Solicitor or Executor.

Quick question.

I am the sole beneficiary of my late mothers estate.

If all debts are paid and all sorted does the bank send the left over money to the solicitor and they pay me whats left after their fees or does the solicitor get the money. Take her fee and then pay the executor to pay me.

  • Why is there a solicitor and an executor?

    They money will go to the executor, or the solicitor operating the executor's account on their behalf, who is responsible for paying all debts and fees due by the estate, and then paying out to the beneficiary(ies).
    A kind word lasts a minute, a skelped erse is sair for a day.

    Yeah i think basically the executor left it for solicitor so sort everything out as often she travels away and isnt always around to deal with things. I haven't a clue how things operate but I really dont have time for executors to be seeing it as the last of their to do list while they do a million other insignificant things.

    Sounds as if the solicitor is acting as executor. In which case they should pay the benficiaries direct after dedfucting their fees from the residuary estate.

    Hopefully. I know these things can take a long time but 7 months in and seem none the wiser. Nothing been released at all apart from funeral and few bills which was done months ago. Probate granted months ago too. Guess it's just a waiting game.

    If they have probate and have taken seven months then they should soon be finished. Have you tried asking them politely?

    Yes I usually drop a text to executor once a week seeing where they are at to which I get the usual. Few more things to sort out. No time frames no this step needs done, or that needs done.

    It's just I really am exhausted financially from everything. I know it's only a once in a lifetime event that has occurred and I'm happy I was able to pay sort and organise things even if I wasn't legally obliged.

    Here's hoping something sorts itself out soon.

    Are you saying you have paid things that the estate should have paid? If there was any money in the estate you should have been refunded promptly.

    Yeah I've probably paid the guts of 2k on mortgage payments, insurance all the catering at funeral and other bits and bobs.

    It's just now it's dragging it heals and just seems that no much is happening.

  • You had no need to do this certainly not the mortgage payment. You should be raising hell with the solicitor and ask for payment now.

    I know I shouldn't have but I was under the impression from what I was told it wouldnt take more than 6 months to sort.

    Little did I know and I'd expect that it still wont be sorted before Christmas. I'm not longer in contact with Solicitor after I expressed concerns regarding the handling of everything.

    Think yorkshireman you've commented on a few of my threads before and seen the messing about that's been going on with houses/rental and all sorts. The sorry thing is there will be a big bill to from solicitor no doubt also.
