Hi All,
I have recently received a PCN and ended up paying it after the internal appeal procedure.
My question is, how much hassle and cost can I make for the company concerned by submitting requests for CCTV footage they have of me? My sample letter below:
I am writing to request that you provide me with any and all CCTV footage of myself that your company holds.
I am requesting this information under the Data Protection Act.
The location: ******
The date: **/**/2017
The first time I would appear : Around 10:00
The second time I would appear: Around 13:00
Description: I am a white male, 6 foot tall, with glasses, very short hair, I was wearing jeans and a t-shirt I arrived in a ***car (***).
As I am sure you are aware, It is your duty to provide me with a copy of all footage that I can be seen in, I expect this will come from multiple cameras. You must provide me with this within forty days and can charge up to £10, if you do intend to make such a charge please inform me of where to send payment.
My address:

*******
I am looking forward to your reply detailing when I can expect the CCTV footage I have requested.
I guess its going to cost them much more than £10 to process this request (They will have to blur other visitors manually I think), but does anyone know?

You will be talking about ANPR and not CCTV
You need the ANPR logs not footage0 -
I guess they run the CCTV as well as ANPR system (perhaps not, guess they will tell me).
This is not about appealing the PCN, it's about causing them maximum irritation. If they do run the CCTV system, I can request all footage they have of me, and they can't charge more than £10. If this turns out to be the case, I plan to visit their site and wander around it for a couple of hours over the course of a day, making sure I walk past lots of other people. They will have to then spend a fortune gettging footage from multiple cameras, blurring out faces (and number plates?) before sending me the footage which I am legally entitled to.0 -
You paid a PCN? Why on earth did you do that? That's money down the drain.
The parking scammers won't have any CCTV images and are under no obligation to provide you with anything now that you have paid them. They will either deny your request or ignore you.
If the landowner had any images, they are under no obligation to provide them either.I married my cousin. I had to...I don't have a sister. All my screwdrivers are cordless."You're Safety Is My Primary Concern Dear" - Laks0 -
As BG and Fruitcake have told you they won't have CCTV footage, why would they that makes no money, they use ANPR which makes them millions.
You would have been far better coming here first and putting together a winnable appeal instead of rolling over and paying scammers.
You have missed your chance and will cause them no problems now at all, sorry!0 -

If CCTV operates on the site, it will be the landowner or retailer
not the PPC.
There is strict data protection on CCTV which can normally
be used by authorities such as the police.
You will not get any information from the PPC as they do not
use CCTV, just ANPR or wardens taking pictures
You are not entitled to CCTV footage unless you have very
good reason such as a crime. CCTV is for security
Don't waste your time0 -
You can request any CCTV footage of yourself of course if it exists but it must be displayed at the site that CCTV footage is being recorded, for what purpose, and who has the footage, similarly if it has anpr the same warnings must be signed.
But it is highly unlikely in a normal car park that cctv footage is being recorded.0 -
"You are not entitled to CCTV footage unless you have very good reason such as a crime."
Utterly wrong, what expertise do you have in this area that makes you think that is the case?

I like the sentiment but you are betting on the wrong dog. Try asking the Council if they have the necessary permissions for their signs, complain to the landowner, retail outlets, local newspapers. Write bad stuff on Facebook, twitter, etc.You never know how far you can go until you go too far.0 -
As has been said previously, it is extremely unlikely that a PPC will have anything other than ANPR cameras. Go and look at any nearby privately managed car park and look high above the entrance/exit. They will be ANPRs, not CCTV.
If you find any CCTV cameras, they are likely to be those of the organisation serviced by the car park, and won't cause the PPC one jot of irritation.
Have a look around the car park you were caught at and see if you can spot any CCTVs - let's have a picture of them uploaded if they belong to a PPC - it will be interesting.
Be careful in firing off a largely speculative request, because the PPC will have not only the £100 (£60?) you've already paid them, they will nab another tenner. Kerching, thanks very much!
Which PPC is involved - we will have information for you about them. Let us know. Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.
