  • Hello again,
I want to ask if would it good to bring to the court any defense docs or skeleton 2 days before hearing?

  • 1. Who was driving?
    2. Was the parking space controlled?
    3. Did the driver know the parking space was controlled?
    4. What was the penalty (as it is a penalty) for breaching the rules as shown at the site on prominent signs.

    That's it.

Why people here want to go to the far end of a fart in trying to twist it otherwise is actually no better that the PPC's themselves.
    1. I was driving
    2. Zone was controled by poorly signage and hard to see it at dark and when it rains.
    3. The Driver haven't seen sign and ignored ticket
    4. on the sign is conditions:
    a) valid UK CPM permit must be displayd
    b) following fees apply. PERKING CHARGE £100 payable within 28days
Very small print that if not paid car keeper details can be requsted from DVALA

Eventually, NTK was send to the old wrong address only debt recorey started presure on me.

Just before the hearing is when you should file your costs schedule (the costs you want to reclaim, if you win, like your travel, loss of leave/salary for attending the hearing, and your parking! and your time in putting this defence & WS together and researching it). Examples are in post #2 of the NEWBIES thread.

You can also if you want, file a skeleton argument that summaries the main points of your defence. You don't have to, but if you think it would help the Judge and you to follow your points of defence in summary format, then prepare a skeleton argument (again post #2 of the NEWBIES thread shows at least one example).

Anything you send to the court must also be sent to the Claimant's solicitors.

And on the day of the hearing, your own file should have everything in it, including printed copies of any proof of 'sent emails' to Gladstones, in case their hired rep pretends that he/she never got your WS, skeleton argument or costs schedule, you can then prove they were sent.

Here is a case that Staceyplindfield won at Brighton Court only the other day, against UKPCM:

    https://forums.moneysavingexpert.com/discussion/5695908

and in post #96 and in the replies, her skeleton argument is shown.

    :)

  • can I use that fact against that claimant UK Car Park Management Limited [ as checked now] is not BPA number but on their sign at the location they have stated that they are BPA?.. in WS they state that sign was audited by International Parking community, it looks like false

on their web I see that they advert this:
As the recognised authority within the parking industry, the BPA represents, promotes and influences the best interests of the parking and traffic management sectors throughout the UK and Europe.
but no any clear statment that their are mumbers..
I contacted BMPA for extra info about them.
