No they did not originally send me this photo, I received only when ws arrived last week, however the sign is not on the route I took or near where parked but further down the estate!
You may wish to point out that the witness claims, (paragraph 15), that the signs have been audited by the IPC; but they, (the IPC), have somehow managed to miss the fact that the sign shows UK Car Park Management as being members of the BPA. (More likely, no such audit has ever been carried out, as the sign also state that you have to have a tax disc on display!).

So the sign isn’t on the route, but ukpc state it was?
That’s something to point out. An operator known for altering photos and submitting false evidence to popla doing it again? Shock.

Tax disc ended in October 2014, so a very old sign! How often do they audit? Unsure why in there witness statement ipc is mentioned thought they were bpa? Probably getting confused again! Attempting a skeleton but just can't get head round it
  • 1.1 The IPC will monitor developments within the sector and make such changes to the Code as appear necessary in response to any changes in legisla on or otherwise. The IPC values the views of consumer groups, operators, landowners and all those a ected by its terms. The Code is a living document and feedback provided by interested par es will be considered whenever it is reviewed.

Ipc does this help me due to out of date signage? However this was not mentioned in defence/ws?

If it was claimed in their WS that the signs were audited, but they have not evidenced that supposed audit, you can CERTAINLY challenge this at the hearing even if it wasn't in your WS. Make yourself some notes about their WS and evidence, that you want to challenge, so you don't forget once in a court room with a Judge.

That's not the full contract because it has to be read in conjunction with the "service proposal", (which appears to be missing).

Furthermore, the authorisation form only allows UK CPM to provide enforcement; it doesn't allow UKCPM to offer parking and more importantly, doesn't allow UKCPM to issue court proceedings in its own name. (Which is a requirement of the IPC's Code of Practice).
  • Excellent thank you kindly much appreciated
